People have pointed out in the past that one of the major limitations to online download music stores is the fact that certain popular artists have not allowed their music to be (legally) offered online yet. Exhibit number one is always the Beatles. Well, now it appears that the Beatles are finally warming up to the idea, but only if someone is willing to pay them lots and lots and lots of money for the right to set up an exclusive Beatles store. That's right, the music wouldn't be available in just any download store, but a Beatles-only music store that would be run by some other company. While the article mentions Apple iTunes as a possibility, this seems unlikely unless the Beatles and Apple patch up their legal problems first. Either way, this points out just how ridiculous all these different online stores are. Would the Beatles have ever become famous if you could only buy their music in exclusive Beatles-only record stores, which would then only play on special Beatles-only record players, that had all sorts of limitations on what you could do compared to other music you owned? The Beatles may have been great musicians, but they now appear to be greedy and shortsighted in their attempt to move into the online world.

et_musicserv.jpgIt's probably not news to those of you knee-deep in portable music players, but ExtremeTech has a nice round-up of the current crop of music download services, from iTunes to Napster to AllOfMP3. You know my take on all this (favorite player: iTunes; favorite service: AllOfMP3), but I have to agree with Dave Salvator when he says that Napster To Go is probably the most compelling service out there right now. It's legal, according to the RIAA and copyright structure, and lets you fill up compatible portable players for not a lot of money. I'll only choke down DRM if I have to, though, so it's still quasi-legal Russian AACs for me.

Anyway, if you don't really know what's up with above-the-board music downloading services, this is a good place to start.

While Walmart made a splash last week introducing their cheaper music downloading service, the folks over at the EFF have noticed that the end user license agreement is particularly painful in basically telling you that you haven't bought a damn thing. You can't do anything with the music you've supposedly "bought". You certainly aren't allowed to resell it - taking away the "right of first sale". All Walmart seems to be doing is giving you a temporary license to listen to music as long as Walmart remains happy with you. As Fred von Lohmann at the EFF says: "Current DRM has nothing to do with preventing piracy, everything to do with impairing consumer rights, competition and innovation."

The new download service is supposed to be in place by March here to coincide with the launch of Sony's player. Tony Smith speculates that the service, once in place, could just as easily be used to push video content down to the device, which doesn't have a hard drive, but can accept flash MemoryStick in 1-2GB sizes—plenty big for a couple of movies.

I think if Sony's got a shot at the iPod, the PSP is it—it can do almost everything you'd want to do while on the road, including productivity stuff (if they release a keyboard).

Okay, someone make it stop. Last week I mentioned HP's plans to open their own music download store and wondered if there was any tech company that wasn't planning their own music download store. Apparently, I was too narrow in my focus. Coca-Cola has announced plans to offer a music download store as well. It's beginning to feel like the "feature" that everyone wants to add. "Oh yeah, our website has a spinning logo, a store locator, search functionality, customer self-service, and, of course, our own music download store." Of course, this will be like every other download music store with silly limitations and bad pricing, but that's the way things go. It's difficult to see what benefit an outfit like Coke stands to gain. It's way (way) out of the core competency, and most of these stores have been shown to act as loss leaders for other products (like music players). I'm not sure how music becomes a loss leader for soda. I'm sure there will be many more similar announcements before some sense of sanity is reached, and companies start shutting down or merging all of these download stores into just a few entities. Having all of these separate stores with different restrictions does no good.
