Nasty telemarketers
06/05/2005 11:31 PMEvery so often we get a call from 888 858 9823. Sometime in the
mid-nineties the phone number was the fax number of some small company
here in Los Angeles, so when it just said "click [silence]" I thought
it was a confused fax machine. Over the last weeks it's become more
frequent. Every few days or so, maybe more. Grrh. Today I tried
waiting a little to see if it was a telemarketer, but nothing
happened. I tried looking...

If
you can't beat 'em, join 'em. A company named
AdNoodle is letting you waive your
rights under the Do Not Call list in exchange for cold hard cash. You
decide how much it's worth to you - 50 cents, $1, $2 per minute - to
have a friendly chat with your local telemarketing concern and answer
a "listening comprehension" quiz afterwards. What's
your conventional wisdom on this one: Are we bargaining ourselves into
a win-win situation? Or are we becoming low-priced callgirls for the
bottom-feeders of corporate America? We report, you decide. (via

Loopholes
Telemarketers Searching For Do Not Call
Loopholes
05/25/2004 04:03 AMThis was predicted, but it appears that less-than-honest telemarketers
are getting bolder in their attempts to pretend they
qualify for the various loophole exemptions to not have to
comply with the federal "Do Not Call" list. Among the things they
do is say that they're a charitable or political organization (both of
which are exempt), and then start pitching financial services that are
clearly not charitable or political. Expect these calls to become
even more common if enforcement from the FTC is slow.

Telemarketers Continue To Sneak Around
Do Not Call List
04/13/2004 02:10 PMLast year, even before the federal "Do Not Call" list went into
effect, we wrote about how some companies were already
workin
g on ways to get around the list by using a sweepstakes with fine
print that signed you up to receive phone calls from their "marketing
partners." In the comments to that article, a number of people have
been writing about one particular Canadian company selling vacation
packages that has been particularly nasty in evading the "Do Not Call"
list by calling with a recording, and any time anyone asks them for
information about the company, they immediately hang up. It appears
that these sorts of tricks
are on the rise. The FTC
says they're cracking down on such practices - even for companies that
abuse the spirit, if not the letter, of the list (though, I wonder if
that'll get them into legal trouble). The craziest accusation in the
article, though, is that AT&T mis-billed over 1 million people (many
of whom weren't even customers), and when those people called to
complain, they were hit with a sales pitch. As for things like
sweepstakes where the fine print says you've signed away your Do Not
Call rights, the FTC says you can only sign away you're rights to a
single company. In other words, despite what the sweepstakes
companies think, they can't pass on your number to "marketing
partners."

06/11/2004 12:55 PMIt looks like the various spam laws that help legalize spam are making
the spammers extra litigious. Following a lawsuit in the US by a
spammer against an anti-spam operation for
still
block their email, some spammers in the UK are
threatening
Spamhaus with lawsuits for still having them on their blacklist.
The problem is that, just because the law now gives them the
permission to spam, it doesn't mean people aren't allowed to make
their own private efforts to block them. The laws may allow them to
send their spam, but there's nothing in these laws that require people
to receive it.

FeedDemon Search Channels
01/16/2004 01:04 PMFeedDemon's "search channels" are the fastest way to find news
items and blogs of interest. A search channel is a dynamic feed which
uses an online search service to look for items containing specific
keywords. Feedster and DayPop searches are built into
FeedDemon, and fans of Blogdigger will be happy to hear
that Blogdigger
support is very easy to add.

No Channels, But Plenty To Watch
No Channels, But Plenty To Watch
07/02/2004 06:02 PMFor years, the joke has been that we kept getting more television
channels, but there was consistently less on TV. It used to be that
the idea of having 100 channels was amazing, but now people have a few
hundred channels to choose from on many TV systems. However, the
latest report from Nielsen says that, for the first time ever,
the
average number of channels available has dropped. TV execs
are freaking out and want a recount. Some are blaming things like
TiVos for the mess, but Ernest Miller (at the link above) makes the
argument that the concept of "channels" is going away thanks to the
internet. People don't want more "channels" -- they want more
interactivity and control, and you just don't find that with TV these
days.

Pick Your Own Channels Law Proposed,

Pick Your Own Channels Law Proposed,
Denied
04/29/2004 11:56 AMA bill is being discussed in Congress that would force satellite TV
companies to put local broadcast TV channels on a single dish.
Apparently, many split the channels between two dishes, and require
you to get both if you want all their local channels. However, more
interesting is that one Congressman has tried to add an amendment to
the bill that would
allow subscribers to do a la carte channel picking -
something many consumers have wanted for many years. Unfortunately,
the amendment was quickly withdrawn after others expressed "concern"
over the amendment - though, it's not clear what their concerns were
(other than making some of their corporate contributors unhappy).
There's still a chance that the amendment will be re-introduced later,
but it seems unlikely to be accepted.

to look for items containing specific keywords, providing an efficient
way to track what people are talking about without having to subscribe
