P2P Wins Court Battle in France

P2P Wins Court Battle in France 03/14/2005 04:34 PM
I take back some of things I had thought about our friends across the Atlantic. A French Appeal Court ruled that a countryman who downloaded 500 movies via P2P was within his rights because he used them for private viewing, not distributing or selling them to the public. He also paid tax on the blank media he recorded it on. No harm, no foul said the courts. Now that is a ruling that makes sense, common sense. Viva Le France! If you can read French, you can find the details on this website.

Heavy-Hitters Join Pro-Municipal
Broadband Legislative Battle

Heavy-Hitters Join Pro-Municipal
Broadband Legislative Battle
06/24/2005 10:01 PM
Dell, Intel, Texas Instruments, and others want more broadband to sell more gear to consumers: They've increasingly gotten involved in the ongoing debate over whether incumbent monopolies and duopolies deserve right of first refusal for broadband deployment in their service areas over municipalities because of incumbents' investments, municipalities' tax-free and bond-raising abilities, and the role of government in competing with private enterprise. The Wall Street Journal walks through the issue, starting with a small town in Texas that's building broadband because SBC can't or won't. The Texas legislature was considering a telecom "reform" bill--a bill which removed many public service and oversight controls on telcos--that would also have banned municipalities from participating in broadband. The original bill was so broad it would have banned virtually all private-public partnerships that the FCC and the Bush Administration have stressed for extending broadband into the furthest reaches of the country. The backlash is now coming since Texas's bill hit defeat for a variety of reasons, partly including Dell's founder picking up the phone and calling legislators. You see, computer makers would enjoy selling more equipment and one way to do that is broadband. (Homes with broadband connections tend to buy newer equipment and more computers, among other reasons.) Pete Sessions (R-Texas) has introduced a bill at the national level to pre-empt local legislation (there's that anti-federalism again) governing municipal operation of broadband. Sessions is the representative from SBC: a former employee with huge stock and stock options held directly (not in trust) with a spouse who currently works there. His chief of staff told the Wall Street Journal that "the congressman's ties to SBC do not present a conflict of interest." Except in that he has millions of dollars at stake over SBC's continued performance in the market....

Musicologist wins copyright battle over
300-year-old works
07/17/2004 11:19 AM
BoingBoing reader John says:
Dr. Sawkins, a musicologist, has won a copyright battle in Britain over a 300 year old piece of music, "Music for the Sun King" by Michel-Richard de Lalande. I understand that particular editions of literature, for example, are often copyrighted: the layout, the footnotes, etc, are all original. But the actual editorial choices- what to include, how to conflate contradictory texts- I had assumed were not copyrightable. By the logic of this argument, a good editorial choice made in one edition of a piece of music can be seen as infringing on the same choice made in another edition.

German Walkman Inventor Wins Battle

German Walkman Inventor Wins Battle
Against Sony, Fixes Gaze on Apple
06/07/2004 12:09 PM

walkman_wm1.jpg imageGerman inventor Andreas Pavel has just settled a 20 year court battle with Sony over the origins of the Walkman, a device Pavel claimed to have patented in 1977. While Sony has spent the better part of two decades trying to ignore his claims of invention (despite the fact they paid him royalty fees for the first few years of the device's life), Pavel's near bankruptcy after a 3.7 million dollar court battle was finally rewarded by a confidential agreement in which Pavel was reportedly paid off to the tune of several million euros. Pavel, cock of the walk, is now planning to take a swipe at Apple, whose iPod has become the Walkman of this generation. Even better, Pavel has another patent in the wings: a 1989 US filing for a technology that combines the features of a portable audio player and a mobile phone. That patent will be decided on 'soon.'

In The Broadband Battle Between Speed
And Price, Customers Choose Price

In The Broadband Battle Between Speed
And Price, Customers Choose Price
12/09/2003 03:39 PM
Back in October we noted that DSL and cable providers were trying to differe ntiate themselves from each other. The DSL providers were focusing on being the low cost provider, while the cable guys wanted to be the high speed providers. At the time, we pointed out that this was likely to backfire on the cable companies. People like the speed of broadband, but for most applications there's a "good enough" speed - and many people want it more for the always on connection than the speed itself. It's looking like we were right. The latest study shows that, despite cable's commanding lead in the US, many more people are signing up for DSL these days because of the lower price. It's the basic "good enough" argument. What DSL offers is good enough for what most people want to do with their connections now. Also, the speed difference is minimal right now. You don't get that much faster speeds with cable, and there's not much you can currently do with that extra bandwidth. It used to be that people would sign up so they could download songs, but the music industry is cracking down on that enough that it's become less of a draw for many subscribers as well.
