British consumer watchdog group Consumers' Association, publishers of Which? magazines and books, on Wednesday announced that they've written to the Office of Fair Trading (OFT) alleging that Apple may be unfairly pricing songs sold through the UK version of its iTunes Music Store. Microsoft Corp. today announced the final version of Windows Media® Player 10 will be available for download at 6 a.m. PDT on Sept. 2, 2004. The new player is designed to make it faster and easier for consumers to discover, download, play and transport their digital media, and includes the first built-in Digital Media Mall, which enables consumers to browse and acquire music and video from a broad number of online stores. The Digital Media Mall includes access in the United States to CinemaNow Inc., Musicmatch Inc., MusicNow LLC, Napster LLC, Wal-Mart Music Downloads and MSN® Music, a preview of which will be made available tomorrow. Windows Media Player 10 also enables consumers to transfer their music to more than 70 portable devices and automatically sync their entire media library -- music, video, recorded TV and pictures -- to new Windows Mobile (TM) -based Portable Media Centers, which Microsoft announced will be available tomorrow at retail.

One of the very good complaints about online music stores is that they offer all songs at the exact same price - which doesn't make much sense in the market place. So, one company is trying to test that out by offer ing dynamic pricing for its downloadable songs. The songs all start at the low low price of $0.10 per song, and then fluctuate based on demand. The company is still paying the $0.67 per song price to the music labels, so they're losing money on plenty of songs - but are saying that's the cost of the experiment. After they've spent the amount they've set aside, they'll go back to the old way of pricing. There are a few problems with this. First, explicit dynamic pricing tends to get a negative reaction from consumers - who feel they get ripped off when someone else bought the same product from the same store at a lower price. More importantly, though, true market pricing isn't just a function of demand - but of supply and demand. In this case, there's an infinite supply, so we're not really talking about market pricing at all. Furthermore, this service competes against plenty of other services that charge around a dollar for songs, so there's a clear upper limit on what they can charge for any song, no matter how popular. An interesting experiment, certainly, but not necessarily indicative of market pricing.

Judge Alex Kozinski is one of the more interesting and entertaining characters on the federal bench, and in spite of being miles apart from me ideologically on many issues, he is one of my favorite judges. Although he starts from a strong ideological viewpoint, he is clearly a man who hungers for new experience, and learns from those experiences. Plus, I have a weakness for people who can write well, and Judge Kozinski is a brilliant writer. If someone could get him to write a weblog, I'd bet it would be in Technorati's top 10 in a few weeks. I corresponded with Judge Kozinski briefly over the revolt he led against Leonidas Ralph Mecham's attempt to monitor Federal Judges' internet usage, saw him in action at the Spectrum Policy debate at Stanford, frequently read his decisions when they come to my attention via Findlaw, and I am a regular reader of his former law clerk Eugene Volokh's weblog. Frankly, unlikely as it might seem, I am a Kozinski fan. So it was with great pleasure that I discovered that another fan, Aaron Swartz, had put together an excellent Alex Kozinski fan website, collecting some of Kozinski's best writing, as well as articles about him. I am delighted that we Kozinski fans of the world now have a home on the web. Thanks, Aaron. Highly recommended for anyone who wants a taste of legal writing at its best....

The iPod is proving a colossal hit on the Japanese electronics and entertainment giant Sony's own turf. The tiny white machine is catching on as a fashion statement and turning into a cultural icon in Japan, much the same way it won a fanatic following in the United States.
