While others are saying that the only way to stop spam is to make people pay for email, others are coming up with slightly more creative solutions. Realizing that having people actually pay money to send emails brings up a lot of other problems, it appears that Microsoft is picking up on the idea of greylisting by creating their own style of spam delay technology called "Penny Black". The idea is that if you're sending email from an unrecognized location, the server will slow your machine down temporarily, making it much more expensive for the spammer - who needs to get more machines and more bandwidth to keep sending out the same number of emails. Of course, these days, with spammers hijacking others' machines, they might not care so much.

As if the upcoming standar ds battle over authenticated email wasn't enough, now someone is claiming that Micros oft stole his patent-pending sender authentication concept, which he also named CallerID for email. He's also accusing them of trademark violation, which may be about as far as his claim can realistically go. First off, without a granted patent, his claims are a bit weak, but even if he got that patent, it seems pretty clear by the fact that just about everyone seems to be coming up with the same idea independently that this is hardly an original idea. The guy in question, realizing that no lawyers seem willing to take on his case, is planning, instead to go after lots of smaller companies to "build up a war chest." Great. Yet another person claiming to hold intellectual property who will now use it to sue other companies that are actually trying to innovate and who clearly never "stole" his ideas, but came up with them independently. Apparently, this is what the Patent and Trademark Office consider "innovation."

Aren't unintended consequences wonderful? Now that anti-spam legislation is becoming popular, one result is that spammers aren't wasting time with just spamming mortgage offers and ways to buy Viagra. Instead, now that they realize they're definitely on illegal ground, they're moving more towards malicious attack spam, including phishing attacks and trojan horse attacks. In other words, if they're going to break the law with spam, they figure they might as well go all out.
