r 1,000. About two months later, we got to 1,500. Apparently we were too busy to celebrate number 2,000,
because that one slipped by before we noticed.
So, here's 2,500, which is cool for the sole reason that my goal
for the site has always been 5,000 posts. For a long while, I managed
to keep up 10 posts per day, but then my job got the better of me and
I slacked off a bit. For the last 30 days, we've been averaging 3.33
posts per day, which seems really low to me. If you take out
weekends, we get up to about 4.
At this rate we'll hit 5,000 somewhere in February 2006. I'll
still be here. I hope you will too.

decided to propose abolishing the compulsory right granted by
section 115 of the Copyright Act. This is
the provision that gives recording artists the right to record
"covers," so long as they pay a specified fee.
Remember
this quote from a 1967 House Judiciary Report, considering a
modification to the law as it existed then:
[T]he record
producers argued vigorously that the compulsory license system must be
retained. They asserted that the record industry is a
half-billion-dollar business of great economic importance in the
United States and throughout the world; records today are the
principal means of disseminating music, and this creates special
problems, since performers need unhampered access to musical material
on nondiscriminatory terms. Historically, the record producers pointed
out, there were no recording rights before 1909 and the 1909 statute
adopted the compulsory license as a deliberate anti-monopoly condition
on the grant of these rights. They argue that the result has been an
outpouring of recorded music, with the public being given lower
prices, improved quality, and a greater choice.

Apparently the Registrer believes performers no longer "need
unhampered access to musical material on nondiscriminatory terms."

06/05/2005 11:19 PMI was reading Business Week and they had a little
commercial section with ads from law firms. A couple of them were
intellectual-property specialists and I snarled internally; whatever
you think about patent law, as a longtime businessman I’m pretty
convinced that the IP law profession, while it contains many good and
intelligent people, is collectively a giant leech sucking money and
time out of the community of innovators. Having said that, two of the
lawyers’ blurbs jumped out at me; both about proposed US legislation
which would institute a new process, within the PTO as opposed to the
courts, for a quick challenge to the validity of a patent. This is
important, because today, defending yourself against
patent-infringement litigation is insanely expensive, $1M and up, way
up. This is why most companies, in particular small companies, roll
over and settle quickly when they get hit with this kind of lawsuit,
no matter how dopey the patent is. Here are the two reports: Defending Against
Patent Greenmail (which begins Patent “trolls” are
currently the subject of much discussion...; most IP specialists
don’t like to admit that patent trolls exist, but they do) and New USPTO
Post-Grant Patent Opposition Legislation on Horizon. I think the
high-tech business community ought to get behind this legislation,
big-time. Everyone except the patent trolls.

Blogger Jeremy Wright was denied entry to the United States and was
strip searched by the US Department of Homeland Security. One of the
reasons for the suspicion was that the officer didn't believe blogging
was a profession. "Blogging ain’t a job," said the officer.
(Maybe I should modify my last post about amateurs and blogging...)
Jeremy has posted a followup entry which is sober and balanced. He quotes from
memory part of the exchange with the DHS officer.
Him: Why
would you visit someone in the states you’d never met (I
mentioned I was planning to visit several people whilst down there)
Me: Well, I have met most of them, but I’ve talked to them
dozens or hundreds of times online.
Him: Do you have any of their phone numbers?
Me: No, but I talk
Him: You can’t talk to someone without a phone number. Stop
lying to me.
Me: No, really, I can talk from my computer to theirs
Him: Don’t be a smartass. If you don’t have their phone
number, and you’ve never met them, how can you have ever talked
to them.
Me: … (at this point I’ve learned that sarcasm
doesn’t help, nor does answering questions he doesn’t want
to hear the answer to)
Him: So, you’re trying to tell me that you’re going to
visit someone who you’ve never met, never talked to and who
knows nothing about you? And I’m supposed to believe
this?
Good point about sarcasm. On my blog I talk tough
about DHS and immigration, but in front of a DHS officer, I'm very
polite and try to say "yes sir" a lot... Immigration is definitely not
a good play to practice your sarcasm.
