To no one's surprise, Canadians elected a minority
government yesterday. The only surprise was Ontario, which delivered
75
of its 106 seats to the Liberals, defying both the pundits and the
polls, and giving Prime Minister Paul Martin 25 more seats than
expected in that province, all at the expense of the Conservatives.
That gave his party a surprising 42 seat plurality over the
Conservatives, who had been expected to eke out a small
plurality. Latest totals are as follows:

What is clear from these numbers is that the electorate has taken a
sharp and welcome turn
to the left in this election. The rightist Conservatives lost
nearly a quarter of their support, and only gained seats because they
combined into a single party to exploit Canada's antiquated
first-past-the-post voting system. The three progressive parties, the
NDP, Bloc and Greens saw their share of the vote rise by 50%.
Canadians
clearly said once again that Bush-style right-wing governments are not
for us. I'm very proud of my fellow Canadians today.
I'm delighted to report that the Green Party got more than double the
2% of the vote nationally they needed to get the new government
campaign funding of $1.75 per vote per year until the next election,
and also behaved so credibly the Canadian media conglomerate won't
dare exclude them again from
the
national leaders' debate next time.
There are at least a dozen seats that were won by fewer than 200
votes,
so until the recounts are over, we won't know whether the NDP will
hold the
balance of power (i.e. since 155 seats is a majority, the Liberals
currently need only include the NDP and the Independent in their
governing coalition, since
together they have, at last count, 155 seats. This would mark the
third
Liberal-NDP coalition in Canadian history, and these have been
Canada's
most responsible and progressive governments. But if the recounts
eliminate this margin, then we're
in for stalemate and probably another election soon. NDP leader Jack
Layton has insisted on an immediate binding national referendum on
Proportional Representation as a condition for supporting the
Liberals,
so we could well see seat totals that are far more representative of
popular vote in the next election -- possibly including at least a
dozen (4% of 308 seats) Green Party MPs!
What was most remarkable about this election, and hardly talked about
at all by the major media, was the stark
urban/rural split in the vote. Canada's Big 3 urban areas
(Toronto, Montreal and Vancouver) went solidly Liberal, the NDP won
almost all their seats in other cities, and rural areas went
overwhelmingly Conservative. While the regional split I have remarked
on before (Liberals in Ontario, Conservatives in the West, Bloc in
Québec) was certainly evident again, the urban/rural split
transcended this regionalism and applied from sea to sea. The 2004
election map won't look much different from the 2000 map above, except
that Reform Conservative blue is now Conservative blue, there will be
a
bit more Conservative blue in Ontario and Bloc blue in Québec,
and a bit more Liberal red in the Atlantic provinces.
It's interesting to note that a month ago, before the voters got angry
and threatened to deal Martin a worse blow. the polls
predicted 143 Liberals, 85 Conservatives, 60 Bloc and 20 NDP
seats,
very close to the final outcome.

There has been a lot of
discussion lately, at least in moderate and left-wing circles, about
the growing evidence of the Bush Regime's deliberate abrogation of the
Geneva Conventions, on the basis that respecting it compromises the
'war on terror'. The best report was Friday on Bill Moyers NOW
on PBS, which included a lengthy interview with Scott Horton, the
lawyer for the NY Bar Association, about the Association's report
on the Bush Regime's arguments for ignoring the Conventions, and their
implication for the safety of American troops, and the integrity of
international law. The report was commissioned in part because of
concerns expressed by the Judge Advocate General's (JAG) office about
alarming and inconsistent instructions that military personnel were
receiving about non-application of the Conventions. These concerns
stemmed from a whole series of classified memoranda from the very top
of the Bush Regime, justifying widespread setting aside of the
Conventions on flimsy grounds, notably a memo
from Deputy Assistant Attorney General John Yoo developed to
pre-justify systematic contravention of the Conventions. Or as
Newsweek
puts it
"a legal framework to justify a secret system of detention and
interrogation that sidesteps the historical safeguards of the Geneva
Conventions."
There is a great deal more on this story. The NOW site above has links
to additional stories. And Joe Conason at Salon.com has a good
summary of it this week.
So the question is: Why is John Kerry not raising this as a serious campaign
issue,
a defining distinction between his policy and Bush's? In the interview
with NOW, Horton says that all the major media, especially the TV
networks, have refused to provide significant coverage of this issue
because "it is too complex to be understandable or of interest to the
public." This is an astonishing position for the media to take, and a
total abrogation of their journalistic responsibility. So, for the
benefit of these media, allow me to make it simple, so that even a
media mogul could understand it:
- The primary purpose of the Geneva Conventions is as a
mutual code of civility, to safeguard prisoners on all sides from
torture, murder and atrocities. As long as all sides in a war agree to
be bound by the Conventions, the war is unlikely to deteriorate into
gruesome and barbaric abuse and slaughter of the innocent. But when
one
side, as the US has now done, disregards the Conventions, it provokes
the other side to abrogate the Conventions as well. So the first
consequence of the Bush Regime's decision that the Geneva Conventions
does not apply in Iraq, Afghanistan, Guantanamo, and other secret US
prisons in the ill-defined and boundaryless 'war on terror', is to
imperil the lives and safety of
American troops, peacekeepers and civilians worldwide. We have
already seen some despicable instances of this.
- Respect for
and adherence to the Geneva Conventions is a
backbone of international law, but it is equally enshrined in American
law. Secret papers calling for the ignoring and abrogation of the
Conventions, from the highest levels of the Bush Regime, are in fact
instructions
to commit illegal acts, and a statement that this government considers
itself above, and not bound by, the rule of law in America.
So we have a government that, by its actions, is threatening the lives
and safety of American troops, peacekeepers, and civilians worldwide,
and putting themselves outside and above the law by commissioning
illegal acts. Surely this is simple enough for anyone to understand,
and surely it is grounds for Kerry to express outrage, demand an
impartial and unimpeded investigation (not another of these farcical
and impotent commissions we have seen so far), and in fact seek
criminal charges against the people responsible. The NY Bar
Association
believes there are ample grounds for this, and they should know
something about the law.
If we reserve our outrage and only prosecute those on the front lines
that follow the orders they are given, and even then only when there
are provocative photos, and if by our inaction we actually encourage
those that commission the illegal and dangerous acts, give the orders,
and then hide behind executive privilege and secrecy, what does that
say about us?
It's time for John Kerry to speak up.

12/19/2004 03:40 PMBefore moving on to the Civil War, it may be useful to say a few words
about the special problems posed by dissent in wartime. Criticism of
the effectiveness of the military, the preparedness of our troops, the
morality of the war, the brutality of casulaties inflicted on
noncombatants, the number of American casualties, the wisdom of our
generals, and so on can easily be seen as the highest form of
patriotism. Indeed, the basic premise of democracy is that criticism
of the government improves the quality of decisionmaking. On the other
hand, such criticism can readily be cast as disloyal.
Civil libertarians are often puzzled by this, but they shouldn't be.
Dissent in wartime may improve the quality of decisionmaking, but it
may also and at the same time strengthen the enemy's resolve. An enemy
that knows we are divided and uncertain will fight harder than it we
are united and resolute. It knows that even if it cannot win
militarily, it might win (or at least obtain a more favorable
settlement) because of domestic American politics. Thus, for those
Americans who are firmly committed to the war, dissenters are acting
treasonably because they are encouraging the enemy and arguably
putting American lives at risk. Their response to dissenters is
essentially, "Can't you see what you're doing? You're jeopardizing
American soldiers! Just shut up!"
Moreover, war unleashes profound passions. Thousands of lives are
stake. No one whose child or spouse or friend is in combat wants to
hear that he or she is risking life and limb for an immoral purpose.
And even less are people willing to hear that when the child or spouse
or friend is already dead or grievously wounded. There is a powerful
need to rally around the troops and to promise that those who have
died have not "died in vain." In such an atmosphere, it is inevitable
that dissent will be equated with disloyalty and that the line between
the two will be blurred. We have seen some of this even in the current
period.
It's also important to point out a critical feature of free speech.
Few people rationally believe that their decision to sign a petition,
send an email, or march in a demonstration will have any effect on
national policy. Thus, the benefit to them of speaking out is very
small. If they have any reason to fear that doing so will land them in
jail, or subject them to government questioning or harassment, or
threaten their current or future employment, they will quickly decide
that it's not worth the risk to sign the petition, send the email, or
march in the demonstration. This is what we mean by "chilling effect."
The danger, of course, is not just that a lone individual will be
silenced, but that an entire segment of the population that would
otherwise be critical of the government will be stifled, thus
mutilating the thinking process of the community.

target="_blank". If you've installed Firefox 1.0 and are
wondering why the suppress new windows advanced pref no longer works,
it's because it's been overridden by a new advanced pref.
To turn it on, go to about:config and set
"browser.tabs.showSingleWindowModePrefs" to true. Or you can add
user_pref("browser.tabs.showSingleWindowModePrefs", true); to your
user.js file.
Then in Tools | Options | Advanced | Tab browsing, a new option
appears. You can then force links that open in new windows to open in
the current window or a new tab instead. It's an experimental option
for now, so it might be a little buggy, but it works for the most
part.
Update: The feature doesn't work on bookmarklets that open popup
windows, like the bugmenot or Post to MT bookmarklets. It opens them
in new tabs instead of as a new popup window.
Update to Update: There's a pref for diverting window.open() calls
too.

Looks like all those pastel
PSPs Sony was showing at E3 were just a tease. According to an
interview in Japanese game magazine Famitsu, Sony claims the
various color PSPs were "just for reference. We plan to make the
system black." I wouldn't worry too much, though. I'm sure if the PSP
does well at all, color models will start showing up in no time at
all.
