While the United States Supreme Court has decided to
examine a key aspect of copyright and technology, several strong
copyright measures have failed to pass through Congress to the
president's desk. These include the controversial
INDUCE Act
and
the Family Entertainment and Copyright Act of 2004 . Amidst a
flurry of lobbying, while the House and Senate each sometimes passed a
bill, agreement between the two legislative chambers did not occur.

d, the FTC came out today against anti-spyware bills that have
been introduced in Congress leading the bill's supporters to
angrily attack the
FTC officials: "You like this stuff? You're the only person in
this country that wants spyware on their computer." The FTC's
argument, of course, is not that they like spyware, but the fear that
any definition of spyware is going to include plenty of legitimate
programs as well. The problem is that no one has yet come up with a
piece of legitimate software that falls under the definition discussed
in various pieces of legislation. It always pays to be a bit wary of
legislation like this, so I don't fault the FTC, but the reasons
presented so far don't make much sense.

The Librarian of
Congress
granted several
exemptions to the Digital Millenium Copyright Act ( DMCA ,
1998). The ruling covers
:
(1.) decoding lists of Web pages or directories blocked by Internet
filtering software, also known as censorware; (2.) circumventing
obsolete digital rights management devices called "dongles" that
prevent access due to malfunction or damage; (3.) accessing computer
programs and video games distributed in obsolete formats; and (4.)
accessing ebooks for which the publisher has disabled the read-aloud
function or the ability to use screen readers to render the text into
a specialized format, such as Braille for access by the blind.
The DMCA provides for the Librarian to review implementations
every three years. Seth
Finkelstein led the lobbying for this set. The majority of
requests for exemptions, however, did
not succeed, and the Act
remains
controversial .

rocketing its way
through Congress so that politicians can tell their constituents
that they "banned spyware" in time for the November elections.
Unfortunately, like with the CAN SPAM Act, the bill they're pushing
could possibly make the problem worse, not better. Even more annoying
is that it sounds as though a much better anti-spyware bill has been
introduced by others -- but politicians have no time to actually look
at which one is better, since they need to rush this bill through
before they all run home to campaign for the election. Politics at

ng the FBI they should work on civil copyright cases or
(most recently) his plan to

the iPod illegal with his INDUCE Act (though, he eventually agreed
to exceptions for the iPods, plenty of other technologies would become
illegal overnight). He's also the guy who tried to defend the INDUCE
Act by admitting it might not be a good idea, but he that's fine as
long as he
does
something. Yes, he believes in legislating for the sake of
legislating even when it might make things worse. Well, it now turns
out that good old Senator Hatch has been
put in charge of
the Senate panel that writes copyright laws. In other words, we
should have another couple years of silliness in copyright laws coming
out of the Senate.

Copyright Board of Canada
issued a ruling on
" private
copying ", largely via peer-to-peer computing, with several
components. First, downloading is acceptable, but uploading is not
(presumably to target hyperpirates). Second, new mechanisms for
levies were described, freezing current ones, allowing new
charges.
the Copyright Board said uploading or distributing
copyrighted works online appeared to be prohibited under current
Canadian law.
However, the country's copyright law does allow making a copy for
personal use and does not address the source of that copy or whether
the original has to be an authorized or noninfringing version, the
board said.

08/05/2004 03:50 AMIt appears that Yahoo heard the backlash loud and clear a few months
back when they released an anti-spyware tool that
just so
happened to skip over adware from Yahoo partners. The latest
version, built on PestPatrol's technology will now
default to
notifying users of both "spyware" and what they consider to be
"adware" and then give the user the choice of what to do. I
haven't tested the product yet, but it sounds like they're moving in
the right direction. It still makes you wonder what they were
thinking in offering a purposely crippled offering. People know what
spyware is, and telling them that spyware isn't spyware doesn't change
how people feel about it. It also doesn't make them look kindly back
at the company that provided them with the bogus anti-spyware tool in
the first place.
