Back in October we noted that DSL and cable providers were trying to differe ntiate themselves from each other. The DSL providers were focusing on being the low cost provider, while the cable guys wanted to be the high speed providers. At the time, we pointed out that this was likely to backfire on the cable companies. People like the speed of broadband, but for most applications there's a "good enough" speed - and many people want it more for the always on connection than the speed itself. It's looking like we were right. The latest study shows that, despite cable's commanding lead in the US, many more people are signing up for DSL these days because of the lower price. It's the basic "good enough" argument. What DSL offers is good enough for what most people want to do with their connections now. Also, the speed difference is minimal right now. You don't get that much faster speeds with cable, and there's not much you can currently do with that extra bandwidth. It used to be that people would sign up so they could download songs, but the music industry is cracking down on that enough that it's become less of a draw for many subscribers as well.

The ongoing battle between telcos and cablecos for broadband dominance seems to be one where it's much easier to note the mistakes than the successes. A new report is saying that telcos are falling even further behind cable -- which, if true, would suggest that the telcos have squandered a golden opportunity. It's not clear that it's true, though. Other studies have shown that the cheaper price and aggressive advertising practices by telcos have helpe d them close the gap with cable providers, who were first out of the gate in the US with broadband offerings. Of course, part of the problem is that the telcos still don't trust DSL. They never wanted to offer it to consumers initially, and only did so when they felt forced to by cable offerings -- even if DSL is now w hat's keeping them alive. However, the cheap DSL prices aren' t really that cheap and the forced bundling with local telephone lines makes the problem even worse. People are willing to buy cheap broadband -- but all of the strings attached mean that it's just as easy to go with cable -- the supposedly "expensive" provider. Add into that equation the fact that at least some cable providers are realizing that by offering VoIP for next to nothing they can steal away more telco customers, and the telcos need to do something. Right now, it appears their focus is on fiber , fiber and more fiber -- but it makes you wonder if they really would have been able to get away with denyi ng fiber to certain locations if they didn't get the regulatory changes they wanted. If cable were eating their lunch, suddenly fiber would look better, no matter what the regulatory environment.

The latest Above the Crowd column from Bill Gurley takes a close look at a recent 9th Circuit Court of Appeals decision concerning whether or not cable broadband services should be regulated as a telecommunications service by the states. Gurley trashes the ruling (which decided they should be) saying that it goes against what the federal government has made clear as well as against what makes the most sense for the internet. Instead, the only group to benefit from this ruling are the state Public Utility Commissions. Everyone else will suffer. He admits that some say the regulation could increase competitiveness, but points out that DSL is already regulated this way and is losing out to unregulated cable offerings (which are even more expensive). He suggests that the market has already shown that they favor an unregulated solution. I agree with the general premise, but I'm not so sure that the current lead cable has is because their "winning" the competitive battle so much as they've more effectively leveraged their own monopoly. I use cable modem service at home because that was the only choice I had - and no one else has come along to offer a compelling alternative yet. However, because my service is a monopoly, it's treated as such: meaning the customer service is dreadful and the prices keep rising. So far, the DSL providers have had their own problems. The real issue is that neither side is doing much to make consumers happy.
