While the United States Supreme Court has decided to examine a key aspect of copyright and technology, several strong copyright measures have failed to pass through Congress to the president's desk. These include the controversial INDUCE Act and the Family Entertainment and Copyright Act of 2004 . Amidst a flurry of lobbying, while the House and Senate each sometimes passed a bill, agreement between the two legislative chambers did not occur.

The Librarian of Congress granted several exemptions to the Digital Millenium Copyright Act ( DMCA , 1998). The ruling covers :

(1.) decoding lists of Web pages or directories blocked by Internet filtering software, also known as censorware; (2.) circumventing obsolete digital rights management devices called "dongles" that prevent access due to malfunction or damage; (3.) accessing computer programs and video games distributed in obsolete formats; and (4.) accessing ebooks for which the publisher has disabled the read-aloud function or the ability to use screen readers to render the text into a specialized format, such as Braille for access by the blind.

The DMCA provides for the Librarian to review implementations every three years. Seth Finkelstein led the lobbying for this set. The majority of requests for exemptions, however, did not succeed, and the Act remains controversial .

Back in January, Nicholas Carr became the latest in a long line of folks to think he came up with the idea for the network computer. He wrote an opinion piece in Business Week saying that the desktop computer was dead and that with all these web-based applications, you'd never need another desktop again. Bill Gates apparently found this article worthy of attention to the point that he's penned a response noting that the power of the PC isn't just in centralized servers but in the fact that plenty of intelligence has moved out to the ends of the network. To some extent, he's underplaying this point. There obviously is plenty of room for server-based applications, and many users are moving more and more applications in that direction. However, just because there are more network-enabled server-based apps, it doesn't mean the power at the ends is useless. Those cycles are an opportunity that can be used, whether in distributed computing applications or for other local tasks.

The United States Congress is considering two new bills concerning copyright infrigement.

The Protecting Intellectual Rights Against Theft and Expropriation ( PIRATE ) Act would expand the Justice Department 's power to pursue copyright infringers. In a related vein is the proposed Piracy Deterrence and Education Act , which would establish punishments for and further government abilities to pursue traders dealing in unusually high amounts of content.

Declan McCullough is looking at one of the anti-spyware bills that's rocketing its way through Congress so that politicians can tell their constituents that they "banned spyware" in time for the November elections. Unfortunately, like with the CAN SPAM Act, the bill they're pushing could possibly make the problem worse, not better. Even more annoying is that it sounds as though a much better anti-spyware bill has been introduced by others -- but politicians have no time to actually look at which one is better, since they need to rush this bill through before they all run home to campaign for the election. The United States Congress' Energy and Commerce Committee passed its own version of the Database and Collections of Information Misappropriation Act , which extends some copyright protections to databases, presently not covered as original work under American law. The dual versions of the law may stall the concept's further progress to the Senate.

In January the Judiciary Committee voted to pass it. The Judiciary Committee's Subcommittee on Courts, the Internet and Intellectual Property approved it late last year .
