04/26/2004 02:38 PMWhile we've all heard stories of companies getting burned by informal
internal emails that say something that looks terrible when it shows
up in court years later, the various requirements for companies to
store old emails is
proving
to be quite expensive. Certainly, the cost of not complying with
the regulations can be quite costly as well, but just managing so much
email - and finding the appropriate emails - is proving to be a
tremendous added expense for some companies. This article makes me
wonder if Google shouldn't look to offer an enterprise version of
their Gmail system. Already, Google sells a box that companies can
use to search their internal corporate network - so, why not offer a
similar enterprise email offering. That way, searching and sorting
through tremendous amounts of email is likely to be much less
burdensome. Still, you have to wonder if all these stories of emails
coming back to haunt people will drive certain executives to move to
other channels of communication that aren't recorded - whether it's
outside email accounts, instant messaging, or just simply talking on
the phone or face to face.

04/20/2004 12:47 PMWhile I agree that rushing into anti-spyware/adware legislation
wouldn't necessarily be a good thing, it's pretty clear that
"self-regulation" isn't currently working. Still, that's
what the FTC is recommending rather than any kind of
anti-spyware legislation, such as the new Utah law that requires
adware/spyware makers to inform users what their programs are doing.
The FTC admits that certain deceptive practices may be illegal
already, and they can go after those companies - but so far it's
obviously done very little to stop the spread of spyware. Instead,
the FTC recommends "education" which certainly hasn't done much to
stop the spread of other internet hazards like viruses, spam, and
phishing attacks. What's more likely to happen is that, as with those
other threats, people are going to increasingly need to get their
hands on anti-spyware applications which will work some (but not all)
of the time. While many tech savvy people already use such
applications, others are going to expect their ISP to protect them,
which, so far, they've been
unwilli
ng to do.

states. However, when the politicians actually decide to write

Senate meeting furiously after he discovered that pro-muni

it's about
time they updated some of their cybercrime laws. This makes
sense, since most computer crime laws are pretty much out of date, but
since so few politicians seem to really understand technology, the
fear is that any update may make things worse. Already, the report
mentioned in the article recommends increasing jail time for
"hackers." That may be good or it may not be, but just using the
generic term "hackers" is a bad sign. The problem isn't with hackers,
but it should be focused on what crime (if any) they've really
committed. The report does note that the police do need to be better
trained in how to deal with computer crimes, and that certainly makes
sense. Still, politicians and computer crime laws seem to have a very
bad history together, and it's unlikely this time will be any
different. The problem is usually that the politicians don't
understand cybercrime, and thus, they over-react to it. Until a new
generation of tech savvy individuals gets elected to office, this is
going to be an ongoing problem.
