Cory Doctorow:
The Federal Circuit Court of Appeals has brought down a verdict in the
"Skylink" case. That's a DMCA case whereing a garage-door-opener
company asserted that another company, which makes interoperable
clickers (in case you lose yours or want a spare for your spouse)
violated the DMCA by circumventing the protection on the copyrighted
software in the garage-door-opener. Yeah, you read right. Copyrighted
garage-door-openers.
Anyway, the court delivered the clearest and most ringing condemnation
of the overbroad application of the DMCA yet:
The DMCA does not create a new property right for copyright owners.
Nor, for that matter, does it divest the public of the property rights
that the Copyright Act has long granted to the public. The
anticircumvention and anti-trafficking provisions of the DMCA create
new grounds of liability. A copyright owner seeking to impose
liability on an accused circumventor must demonstrate a reasonable
relationship between the circumvention at issue and a use relating to
a property right for which the Copyright Act permits the copyright
owner to withhold authorization-as well as notice that authorization
was withheld. A copyright owner seeking to impose liability on an
accused trafficker must demonstrate that the trafficker's device
enables either copyright infringement or a prohibited circumvention.
Here, the District Court correctly ruled that Chamberlain pled no
connection between unauthorized use of its copyrighted software and
Skylink's accused transmitter. This connection is critical to
sustaining a cause of action under the DMCA. We therefore affirm the
District Court's summary judgment in favor of Skylink.

universal garage door opener does not violate the DMCA
for circumventing the original garage door opener maker's copy
protection system. The judge seems to take a common sense approach to
the matter, pointing out that it's ridiculous to believe that opening
ones own garage door could be seen as a violation of the DMCA. This
is a good ruling, and hopefully we'll see more based on this
precedent. Now, the question will be whether or not people will be
able to use such a ruling to support the idea of being able to open
other things they thought they owned - like a gaming console or some
software...

09/01/2004 04:06 AMThe Court of Appeals has upheld an earlier ruling saying that it's
not a
violation of the DMCA to create garage door openers that get
around manufacturer controls designed to force buyers to go back to
the original company for replacement openers. A lot of analysis is
coming out on this one for a variety of reasons -- but, basically both
the case and the decision are both incredibly complicated and
incredibly important. The court basically wants to establish some
sort of balancing "test" for the DMCA. However, the DMCA and certain
decisions associated with it are fairly problematic to begin with, so
the test is somewhat convoluted and not entirely reasonable. The good
part is that the court seems to recognize just how troublesome the
DMCA is as written. The problem is that they don't really know what
to do about it to bring it back in line with where it should be to
avoid its misuse for anti-competitive purposes. It sounds like a bit
of cognitive dissonance as the court tried to resolve the realization
that the law really was as bad as some made it out to be with the idea
that Congress couldn't possibly have meant for it to be that bad.

decision that said file sharing programs weren't liable for
copyright infringement that occurred on their networks, the Appeals
Court has
upheld the original ruling. The Reuters report only
has two paragraphs now, but I'm assuming it will be expanded with
details. Once again, it looks like the courts have been able to
understand the difference between a person doing something illegal,
and a company that provides a tool. This ruling isn't a huge
surprise, of course. During the trial, the judges made it clear they
weren't
buying the entertainment industry's version of the story, when the
judge told the RIAA lawyer: "Let me say what I think your problem is.
You can use these harsh terms, but you are dealing with something new,
and the question is, does the statutory monopoly that Congress has
given you reach out to that something new. And that's a very debatable
question. You don't solve it by calling it 'theft.' You have to show
why this court should extend a statutory monopoly to cover the new
thing. That's your problem. Address that if you would. And curtail the
use of abusive language."
