Hi Dave,
As an attorney, practicing in the areas of international business and
immigration law, it has come to my attention through discussions with
other attorneys, that DHS is pulling aside "selected" aliens at entry
checkpoints and bringing them into a separate room which contains a
DHS computer connected to the internet. The aliens are told to bring
up their various email accounts on the screen and enter their
passwords. DHS then reads the emails for information pertaining to
possible unauthorized work or other matters and questions the aliens
on these findings. Of course, no attorney can be present at these
interrogations! People travelling to the U.S. should be aware that a
possible search of them by DHS now also means a search of their email
accounts!

This means that I should probably be
careful not to have any suspicious looking email on my computer
either. This also creates a vulnerability for aliens entering the US
because someone could send them a bunch of sketchy email that would
get them in trouble when they are about to enter the US...

I find this very difficult to believe.
How many people can remember the hostname, IP address or URL used to
access their email, without the benefit of bookmarks or an
preconfigured mail client? How many can even remember their password?
For most people, their account and client would be set up by their
employer or their ISP. They boot up Outlook and it just works. I know
I couldn't provide this information, particularly after a long-haul
flight, nicotine withdrawal, and standing in line at passport control
for an hour.
And how would DHS know what email accounts you have, anyway?

vigilant in defending itself against terrorist attacks. In
addition to bombing the shit out of the Middle East, we have also
established the Department of Homeland Security whose responsibility
it is to defend us from terrorists. They have so far done a stellar
job, as the U.S. has yet to be hit by another terrorist attack.
But the ever-vigilant Department of Homeland Security is not
resting on its laurels. Recently, they prevented the terrorist
supporter Yusef Islam from entering the United States.

12/16/2003 12:31 PMI'm sure all of the many many sites focusing on the SCO lawsuit will
have more thoughts on this, but the latest news is that, despite an
original ruling saying that SCO needed to make the disputed code
public, SCO has now convinced the judge that they should
o
nly present the "evidence" of infringement to the judge, jury and
IBM. This means that the open source crew, who have been doing an
excellent job picking apart each sample of "infringing" code that SCO
has shown so far won't have the ability to go through the rest. The
reasoning, of course, from SCO's point of view is that opening up
their source code to the public means that it will never get to put it
back in the genie bottle. However, that makes no sense. If the
entire claim is that this code was taken out of SCO's source code and
put into Linux, then the code
is already public. Displaying it
again does nothing to lessen SCO's control over the code if it really
is already out there. The only thing it really does (and the real
reason SCO wants to do it this way) is make it more difficult for IBM
to go through the code and figure out if (as has been the case so far)
SCO is wrong in their claims. This is not a surprise, of course, as
SCO has done everything possible to make the process as difficult on
everyone else - including the news last week that they delivered the
"infringing source code" to IBM on a million sheets of paper. You get
the feeling, sometimes, that SCO believes this is all a big game.
They're acting like the bratty first-grader who insists on some sort
of strict interpretation of what he's been told just for the sake of
annoying everyone around him.
