A week and a half ago, we wrote about how a court had overtur ned an earlier ruling for Netscape (now AOL) against Playboy, saying that Playboy couldn't sue if Netscape sold the search term "Playboy" to competitors of Playboy. Now, rather than fight the legal battle for something that doesn't really matter to them, AOL has apparently settled (read: paid up) the case out of court. This is too bad, as this sort of case is only going to return to court at some point. Once again, though, I believe Netscape was in the right. To me, keywords are the same as shelf placement in a grocery store. It's not being used to confuse people, but to entice them. Everyone knows Coca-Cola, so if you want to sell Bob's Cola, you want to make sure you're next to Coca-Cola on the shelf. No one is going to confuse you for the other, but someone looking for Coca-Cola may (or may not) notice Bob's and check it out. It's not trademark infringement. It's competition.

Most of the time, the life of a wayward freelance geek journalist is fraught with stress, challenges, unpaid invoices. Well, last night wasn't one of those times. I went to the Playboy Mansion to interview Hugh Hefner, and cover the launch of a new Playboy-themed electronic game for Wired News and National Public Radio. In the game, you get to be Hef, doing hefsterly things like -- oh, nailing 18 year old hotties, and managing a booming porn publication empire.

I sat down with Mr. Hefner and his gorgeous companions, and asked him if he felt the game designers had created an accurate virtual depiction of the world in which he lives. "It's pretty good, other than the fact that they gave me this giant Jay Leno chin," he said. There was much butt cleavage in effect. Beautiful women with tromp l'oeil lingerie painted on their perfectly engineered breasts served little snacks off flawlessly polished silver platters (see image at left). Oh, and in case you're wondering -- there is no WiFi inside the grotto, although there is one very heavily used mattress. NPR and Wired News stories coming up.

Lots of folks are picking up on the story that a man accused by Verizon Wireless of sending text message spam has received a permanent injunction against sending SMS text message spam to mobile phones. However, the more important part is whether or not it matters. The guy in question seems to have disappeared. It's barely mentioned in the article, but he didn't show up at the hearing at all, and the article suggests his last known address is not valid. Basically, it sounds like the guy skipped town, or at the very least, didn't care enough to show up for a case against him. It seems unlikely he's going to let a random judge tell him to stop sending SMS spam.

Florida prosecutors have been granted an injunction against two men accused of running mass e-mailing operations, in what is the state's first victory against spam. The move will prevent Scott Filary, 25, and Donald Townsend, 34, both of Tampa, from sending deceptive e-mails. It's the first to be granted under an anti-spam law passed in the state last year.

The pair are accused of sending more than 65,000 e-mails, with misleading subjects and disguised origins, and Charlie Crist, attorney general, said links took recipients to sites engaged in fraud or illegal activities like selling pharmaceutical drugs or cigarettes online.

Anti-spam laws in Florida allow for a fine of up to $500 per e-mail sent - making the two accused liable for a fine of up to $24 million.

Alacritech argues that Microsoft's software violates two of its patents relating to scalable networking, US Patent No. 6,427,171 and US Patent No. 6,987,868, both entitled Protocol Processing Stack for use with Intelligent Network Interface Device. The injunction claims that in 1997 Alacritech invented network interface software to speed up data flows across networks. In 1998 it approached Microsoft to see whether the software giant would be interested in licensing the technology. There are fears that the injunction may delay the release of Longhorn which is scheduled to appear next year.
