As we reported just yesterday, Eolas has lost two of three legal disputes with Microsoft over it's patent and licensing claims. Eolas now claims the fight is far from over and has mailed an "office action" to the U.S. Patent and Trademark Office.

Eolas says the patent office had wrongfully withdrawn 10 of it's previous claims, including a previous finding from February. Eolas attorney Martin Lueck, of Minneapolis-based Robins, Kaplan, Miller & Ciresi LLP, said the patent office examiner had issued a new action—based on yet another piece of "prior art"—to reject the patent's claims. The prior-art piece was outside the examples offered by the W3C (World Wide Web Consortium), which brought the prior-art question to the attention of the patent office in November 2003.

"Eolas is attacking HTML itself. This goes to our heart," W3C CEO Steve Bratt said. "The patent could force Web site owners to modify their pages and server-side applications."

The latest exploit is a file called "img1big.gif" that decompresses into a malevolent Browser Helper Object (BHO) that captures your financial transactions. According to a report from SANS, this BHO: watches for HTTPS (secure) access to URLs of several dozen banking and financial sites in multiple countries. When an outbound HTTPS connection is made to such a URL, the BHO then grabs any outbound POST/GET data from within IE before it is encrypted by SSL. When it captures data, it creates an outbound HTTP connection to http://www.refestltd.com/cgi-bin/yes.pl and feeds the captured data to the script found at that location. There are only two choices left with IE: Either don't browse the web with it, or don't use it for financial transactions. Thank goodness there are choices like Mozilla, Firefox and Opera, for those of us still chained to Windows....

I spend anywhere from three to eight hours every week sweating along with a motley crew of local misfits, shelving, sorting, and hauling ton after ton of written matter in a rowhouse basement in Baltimore. We have no heat nor air conditioning, but still, every week, we come and work. Volunteer night is Wednesday, but many of us also work on the weekends, when we're open to the public. There are times when we're freezing and we have to wear coats and gloves inside, making handling books somewhat tricky; other times, we're all soaked with sweat, since it's 90 degrees out and the basement is thick with bodies. One learns to forget about personal space when working at The Book Thing, since you can scarcely breathe without bumping into someone, and we are all so accustomed to having to scrape by each other that most of us no longer bother to say "excuse me" unless some particularly dramatic brushing occurs.

Unveiled yesterday in Japan, Samsung has shown what it claims is the world's first mobile phone that incorporates a hard drive.

The SPH-V5400 includes 1.5GB of hard disk storage as well as an FM radio, 64-voice polyphonic ringtone support, a 240 x 320 display and TV output preparing the way for the day when mobiles incorporate Microsoft Portable Media Center-style functionality.

When the SPH-V5400 goes on sale in South Korea later this month, it will retail for around $800.

A recent <A HREF="http://www.forbes.com/technology/2004/09/17/cx_ah_0917tente ch.html">article</A> on Forbes.com about the Apple/Beatles lawsuit contains an interesting footnote that brings to light and an more interesting question: Can the iPod name survive without the Apple brand? While the reverse is already being tested by Hewlett Packard, it remains to be see whether any of Apple's products can survive without their namesake. For all of Apple's unique and unmistakable designs, what would happen if the Apple was removed from the front of the iMac? Or the 23-inch Cinema Display? Or the back of the iPod? Forbes seems to think that a move away from the Apple name and symbol "would harm its prospects not one bit. "The iPod brand is turning out to be as powerful a brand name as that of its corporate parent. By itself, it's also free of any expensive encumbrances involving musicians who haven't done anything terribly interesting in the last few years (i.e., The Beatles)." The iPod name is certainly strong enough to exist on its own, but would there be any benefit (aside from the Apple/AppleCorps dispute)? Could Apple create better computers — or better music players — if the pressure was off to do both under the same moniker? I'd like to personally think not, and with the unveiling of the latest iteration of the iMac, it seems that Steve Jobs & Co. can certainly do both, and do it well, if not borrowing from the other side along the way. The iPod is as much Apple as it is its own individual namesake, but splitting the two would likely cause separation anxiety for one — or even both — parties. It's not secret that the iPod has brought Apple back to major player status, and while it may be true that Apple the computer company has ridden Apple the music company to new heights, they most certainly need each other to survive. I mean, just take a look at <A HREF"www.apple.com">Apple.com</A>…

First of all are these guys idiots. Actually offering $25,000 for someone to write a Mac Virus that they want to spread net wide. I tell you what I am going to do. If my Mac gets infected because of their actions I am going to sue them for damages. I am not a sue happy type of guy, quite the contrary but these types of actions need to be handled in a way that makes companies think twice before doing something so idiotic.

I had to look at the calendar to make sure it was not April's Fools Day as this is the most crazed thing I have seen someone do yet. To be so damn arrogant that you think a Mac is above getting a virus.

It's pure arrogance and that is what is going to do them in. Some hacker is gonna say ok I am gonna teach these arrogant fools a lesson and release something so horrific that Mac users worldwide will wake up with a hard-drive that has been formated or worse.

How many times do I have to say it. Their a bunch of idiots. They think their precious operating systems is so strong that it is safe from any Virus. They are going to eat lot of crow and I hope the Mac community speaks loudly and smacks them in the head.

I have already vowed to never buy a product from this company ever. I swear they are now on my forever I will not do busiess with stupid people list.

Now the iPod can be used as a recording device, too, for directly storing and playing back audio. You're not going to want to record your band's demo on your iPod, but if you want to capture close-range interviews or voice memos, the Belkin Voice Recorder for iPod and the Griffin Technology iTalk iPod Voice Recorder can get the job done. dockconns.jpg imageFar be it from me to begrudge anyone the opportunity to tear apart a ridiculous consumer product, but no matter what the guys at Whining Dog say, I think this Belkin TuneDok iPod holder is pretty clever. It's basically just a simple travel holder for your iPod, doesn't do anything terribly fancy, or electronic, even, but it does have the good graces to slip comfortably into any available cupholder you have in your car, putting your iPod at a more comfortable eye-level (hopefully) and saving it from unsightly scratches.

You might say the $40 price tag sort isn't in line with its overall usefulness, and you'd be right, but when these things invariably drop to $9.98 at your local Best Buy, it's not going to look like such a rip off.
