So I'm sitting here at PC Forum listening to Joe Kraus (JotSpot) talk to Marten Mickos - the CEO of MySQL. Joe is finding out all about MySQL's dual license model and their version of the 'honor system'.

It would be super coolio if JotSpot adopted a similar model.

JotSpot is a platform and offers developers an app exchange/marketplace for them to sell their JotSpot apps and services.

This is something of an odd interview -- and it's not entirely clear why Business Week has chosen to use it, but it's with a kid who really likes some new band, and even though the band offers all of their music online for free, he still feels it's worth it to buy everything they release, just because they release it. The free music acted as a promotion that got him hooked, and caused him to go out and buy the albums as well as making sure he goes and sees them perform live as well. While it's just one anecdotal example, it does hold a lesson the industry needs to learn. Their first response, of course, would be that this is just one kid and they're trying to protect against everyone else who wouldn't be so honest. However, more to the point, there's a marketing message. The kid makes it clear that he'll buy a product he sees value in -- and it clearly has to do with the packaging and the band behind it. The industry continues to think they're selling "music." But, they're really selling "the band" and everything that entails, including how the music is packaged (nice CD material? extra features?), concerts, fan-wear, fanclubs, access to the musicians and plenty of other things. Once they realize that, they can see that the music is simply a way to promote all of the above. Will some people just take the music and nothing else? Sure. But that's no different than people watching a commercial and not buying the product. The music itself has promotional value, which the industry seems to deny.

While everyone's jumping into the music download store business, some are finally questioning whether or not the $1/song price is the right price. Many people say the price is way too high to get mass adoption on a large scale, but the record labels are complaining that they can barely make any money at that price already - since they need to sell so many songs at $0.99 per song to make up for the loss in album sales. Maybe it's time they started offering things that were worthwhile on top of just the songs to get people to believe it's worthwhile to pay up. If they believe they can't make money selling music at a price people are willing to pay for it, then clearly they're in the wrong business. I'd love to be able to each post of Techdirt for $10,000 per post, but I recognize not enough people are willing to pay that (in other words, no one is) for me to make a living that way. Thus, we had to come up with a different business model here. If the price you want to charge is above what the market is willing to pay, then you're not going to last very long. Sure, some people are buying music at $1/song, but it's still a small segment of the market.

It’s all over the news that a Canadian judge has ruled that posting copyrighted works on a P2P network is not against the law. (I have no idea how long-lived that URI will be, Canadian newspapers are not very careful about their web-space). I wonder if the ruling extends to the Web? I would just totally love if it I could post the occasional excellent piece of music here, and I bet it would drive business to the artists and their published works; and I’d love it if some of the other people whom I’ve gotten close to via their writing were able to share some of their faves with me, too. Go, Judge Finckenstein!

My new favorite blog Sellout Central points to an interesting story on Christian Piracy. Quoting:

only 10 percent of Christian teens considered music piracy to be morally wrong, according to The Dallas Morning News

I plunge the depths of the internet from time to time just to see what the scene is like and I've been surprised by the presence of things like the Passion of the Christ movie and soundtrack being traded around, bible programs being swapped, and people openly requesting pirated copies of christian-themed files. I would think if anyone considered downloading stuff online to be akin to stealing, it would be faithful followers, but apparently that's not the case.
