08/19/2004 11:11 PMIn a scathing editorial published by British medical journl The
Lancet, bioethicist Dr. Stephen H. Miles says U.S. military medical
personnel were complicit in detainee torture incidents that took place
in Iraq, Afghanistan and Guantanamo Bay, Cuba. The document details
cases of alleged abuse participation by medical personnel, and calls
for a formal inquiry.
There are isolated reports that medical personnel directly
abused detainees. Two detainees' depositions describe an incident
where a doctor allowed a medically untrained guard to suture a
prisoner's lacertation from being beaten. The medical system failed to
accurately report illnesses and injuries. Abu Ghraib authorities did
not notify families of deaths, sicknesses, or transfers to medical
facilities as required by the Convention. A medic inserted a
intravenous catheter into the corpse of a detainee who died under
torture in order to create evidence that he was alive at the hospital.
In another case, an Iraqi man, taken into custody by US soldiers was
found months later by his family in an Iraqi hospital. He was
comatose, had three skull fractures, a severe thumb fracture, and
burns on the bottoms of his feet. An accompanying US medical report
stated that heat stroke had triggered a heart attack that put him in a
coma; it did not mention the injuries.
Death certificates of detainees in Afghanistan and Iraq were falsified
or their release or completion was delayed for months. Medical
investigators either failed to investigate unexpected deaths of
detainees in Iraq and Afghanistan or performed cursory evaluations and
physicians routinely attributed detainee deaths on death certificates
to heart attacks, heat stroke, or natural causes without noting the
unnatural aetiology of the death. In one example, soldiers tied a
beaten detainee to the top of his cell door and gagged him. The death
certificate indicated that he died of "natural causes . . . during his
sleep." After news media coverage, the Pentagon revised the
certificate to say that the death was a "homicide" caused by "blunt
force injuries and asphyxia."

05/03/2004 08:43 PMIn case anyone missed this, there is a detailed
article on the torture at Abu Ghraib in The New Yorker. Unlike the sniper rumor, this one is pretty much
documented fact. I realize that this is obviously not standard
behavior, but it is not a single wacko, but a group of soldiers. It's
really quite appalling. How can something like this happen? What is
the mood like among American soldiers in Iraq? Is there a general
hatred or is it really isolated behavior? I can't imagine an occupying
force being very successful without some basic respect for the local
citizens.
I remember hearing that the occupying forces in post-war Japan were
selected from soldiers who had not served in combat against the
Japanese. Most of the stories you hear about the soldiers occupying
Japan are good stories. I suppose it's easier to be nice when there is
no resistance, but still... (My sister has a nice post about the story of our family's
first interaction with the US occupation of Japan.)
I also heard from a Spanish friend of mine that there is very
little if no hatred towards Muslims after the 3/11 attack in Madrid.
People realize that it is a splinter group and are not blaming the
Muslims.
I don't want to over-generalize, but trying to link Al Qaeda to
Iraq and some of the hate crimes against Muslims in the US really
highlights the lack of racial sympathy or understanding on the US's
part. I think the US really needs to figure out how to deal with this
racial intolerance and ignorance if it's going to try do any kind of
nation building.
Before someone else says it, I think racism in Japan is also very
bad, but we're not toppling regimes and trying to rebuild them. I
wouldn't trust Japan with that either.

Apple has sued a bunch of bloggers for
releasing information about their upcoming products. The thing is, a
journalist is protected by the law, so that they don't have to reveal
their sources, but Apple has managed to convince a judge that a
blogger is not a journalist, and therefore must reveal their sources.
Dan Gillmor writes about this in depth,
being a blogger and a professional journalist. He has some quite
excellent points, I recommend that you read it. An interesting piece
of information is also this article from CNET that suggests
that in the future, blogging and other form of citizenship journalism
might be subject to FCE regulation in the U.S., due to the fact that
linking to a political campaign might be considered official support,
and therefore subject to the same regulations as all monetary support.
I think this discussion will happen also in Finland in the near
future. An unregulated internet where anyone can say
anything they like is a horror to anyone in power. It's quite
likely that also over here there will eventually be attempts to limit
freedom of speech online - our very own Minister of Culture, Ms.
Karpela, is already trying to circumvent the relevant laws to make sure
that "filth" (as defined by your average geek writing a
crappy program, owned by a corporation with commercial interests, and
supervised by your average alarmist Christian) would be censored from
the Internet.
All this talk about censorship and regulation makes my head ache.
It won't work - get over it already. Embrace the change: the winners
will be found in the crowd that accepts this first.
The alternate is that only professional, accredited writers have a
freedom to speak.
Update: The FEC article has been shot down by representatives of
FEC. And a good thing, too. I guess it shows that politicians
will have to be even more careful about what they say, lest the
blogger horde misinterpret them. However, I think in general it's
good to have public review of important decisions - blogs have a way
of turning legalese into something human-readable. Perhaps it is not
always right yet, but it's getting more so.
Update2: Blogger Garrett M. Graff has
been admitted into a White House news briefing,
says CNN. Just as an interesting data point...
Update3: Kari Haakana has asked the Finnish Journalist Union,
and got a response
confirming that in Finland the right not to reveal your sources
extends to any kind of online publishing, including bloggers.

In yesterday's discussion and in Charles Leadbeater's discussion
the day before, there was a lot of talk about the rights of amateurs,
the "pro-am revolution" and other arguments about how amateur content
and creativity was important. I described how in the blogging world,
it's mostly the people who create content who "pay" in contrast to the
professional content world where it is the creator who gets paid. I
talked about how Creative Commons was really helpful for amateurs who
were more passionate about having their works widely accessible than
making money. This is not to say that Creative Commons isn't useful
for other things of course.
There was a bit of slippage in the discussion in the afternoon when
several people pointed out that maybe I was suggesting that amateurs
shouldn't/couldn't become professionals. The point, if I understood it
correctly, assumed that most amateurs wanted to be professionals and
that somehow amateurs were proto-professionals or professional
wannabes. At least some of them.
I think this is a mischaracterization and maybe a reason to dump
the word "amateur". I think that in the case of many amateurs such as
many bloggers, Wikipedians and most open source developers, the
amateurs are happy being amateurs and don't feel that they are in any
way inferior to their professional counterparts. Many of the heads of
open source projects have a day job, but probably believe that they
are superior to comparable professionals at Microsoft or other
software companies. I doubt that many Wikipedians wish that they could
get paid for what they do. There are very few people who prefer
professional sex to amateur sex. (I think I got this example from
Steve Weber's book.)
My sister pointed this out to me last week by IM as well. I think
the answer lies in the mode of production. Money creates a power
relationship between the payer and the payee. I think cases where the
production is happening in some sort of enterprise or a "firm" where
having a manager and having access to resources allows production to
be more efficiently, financial relationships and "professionalism"
seem to "feel OK." On the other hand, when working in what Yochai
Benkler calls "commons-based peer-production," the "professionalism"
is replaced by amateur passion as a primary driver.
I pointed out several times yesterday that I don't want to impinge
on the rights of professionals, but I believe that monopolistic
professional organizations such as rights collection agencies, the
Hollywood lobbies and Microsoft are hurting the ability for amateur
artists from participating by creating technology and legislation that
focuses exclusively on protection instead of the sharing of
creativity. I think it is the role of government to call into question
the practices of these monopolies which are the unfortunately
byproduct of an unchecked free market economy and prevent the passing
of legislature that increases the power of these monopolies such as
software patents and extension of copyright terms. Instead, they
should be focusing on activities that make it more difficult for such
monopolies to form such as focusing on open standards and open source
and whenever possible, preventing proprietary standards from being
funded by public funds.
