New legislation recently introduced by a group of powerful U.S. senators would allow artists and entertainment companies to sue creators of products, such as peer-to-peer (P-to-P) software, that "induce" copyright violations. Senate Judiciary Committee chairman Orrin Hatch, clearly targeting P-to-P vendors, claimed his bill focuses on companies that profit by encouraging children and teenagers to infringe copyrights. "It is illegal and immoral to induce or encourage children to commit crimes," Hatch, a Utah Republican, said in a statement. "Tragically, some corporations now seem to think that they can legally profit by inducing children to steal. Some think they can legally lure children into breaking the law with false promises of 'free music.'"

What is the Best Way to Handle a GPL Violation?: There should be a Web site solely to track GPL violations. It'd be a nice way to keep everything in the same place.

When you find that somebody is violating the GPL by distributing your code or a derivative of your code as a closed source product, how do you go about handling it? I have found two violations of the GPL for my Java Utilities, in the last month.

Microsoft Word corrects many of my typos and misspellings as I type. I'm not sure exactly how I turned it on, how to turn it off, or where the list of errors is maintained, but it's pretty helpful. ...Except that it corrects my trademark violations. For example, if I type "laundromat," it goes tut-tut and changes it to "Laundromat." I violate trademarks with pride and I don't want to be in a culture war with my word processor. Besides, is Microsoft going to issue a patch so it slaps a trademark on "That's hot" now that Paris Hilton has trademarked...

Try, try again. It seems that even if Microsoft can shake the government's antitrust pursuit, they're still getting hit from other angles. The latest is that RealNetworks has filed an antitrust suit against Microsoft, claiming that they're using their operating system monopoly to limit choice on digital media. They're going to ask for somewhere around $1 billion dollars. Microsoft has done an amazing job shaking off every such lawsuit in the past. You wonder if, one day, one of these will stick.

The Justice Department has ended antitrust investigations into the music industry's early attempts at online music stores, MusicNet and Pressplay - both of which were seen as pretty disastrous failures. The original complaint was that the music industry was making it hard for others to offer music online in order to help boost sales of their own efforts. What happened was the industry's own efforts didn't go very far, and now just about everyone seems to be doing deals with the industry to set up download stores, so it's not too hard to see why the DOJ is shutting down the investigation. Of course, another investigation could be made if anyone decides to look into the question of why the industry is holding a universal line on the price per song download.

The question of mobile phones in schools has come up many times - and the general opinion towards them seems to change with the times. It used to be that they were banned, but following Columbine and September 11, many schools changed their minds, realizing that phones serve a safety purpose as well. More recently, schools are banning them again as they fear the overhyped potential of camera phones to cause problems. No matter what, though, schools most schools are pretty strict in saying phones should not be used in class (for obvious reasons). Thus, it's not news worthy to hear of a mobile phone being confiscated from a high school student by a teacher and a a school administrator. However, for them to then take that phone, check its text messages and voicemails, call other students in the addressbook and send out deceptive text messages seems to go well beyond what should legally be allowed. The teacher and the assistant principal involved claimed that they believed the student was involved with drug dealing after reading a text message from his girlfriend asking for a tampon (which they claim is common drug slang). Of course, that means they read the text message before they suspected him of any drug dealing activities. Furthermore, to then call other students and demand they come down to the office, as well as sending deceptive text messages to others seems to go well beyond what is acceptable practice in confiscating a phone. The family of the student is now considering taking the case to court, while the school district is still trying to defend their actions. The article linked here has quite a few details behind the case, so it's definitely worth reading.
