virtual worlds, but there are also plenty of economic issues (which
often are related to the legal ones). Wired News is running an
article looking at
some of
the economic info available about various online games and comes
to the conclusion that the only thing that really matters is if the
game is still enjoyable to its players (which seems fairly obvious).
It's not important that a virtual economy be a "successful" economy in
the traditional sense as long as it's fun for the players. Of course,
a disastrous in-game economy isn't going to be that much fun, which is
why many more games (usually from the smaller online gaming companies)
are paying a lot more attention to the in-game economic situation.

apple into honey? Even if we program the honey to get stuck on the

11/13/2003 02:55 PMJust in dealing with websites there have been all sorts of legal
questions about jurisdictions and do offline laws apply in an online
world. Now the issue is becoming even more complex as more and more
"virtual world" games are showing up - and actions in those virtual
worlds may seem very much like actions in the offline world. So the
question is whether or not those actions are just "part of the game"
or are they real actions with legal consequences. It's a very fine
line. We had mentioned this issue
a
couple months ago, but now some folks are holding
an entire
conference focused on the legal questions presented by online
gaming. Some think that the virtual worlds will be a good
"testing ground" for new laws and rules that could be applied in the
real world. However, others are simply focused on how offline laws
carry over into the online virtual worlds. If someone steals from
you, is it theft? If someone defames you, can you sue? The biggest
issue, it seems, is when real world money crosses over into the
virtual worlds. Once money gets involved, so does the law - which
could present problems for the crop of new games focused on bringing
in real money. In many cases, it seems that the company creating the
virtual world really is that world's government - and they make the
laws that apply within the sandbox of the virtual world. Still, many
people will undoubtedly try to pull things out of that sandbox and
into the very real world court system.

study the real one? The Gross National Product of EverQuest,
measured by how much wealth all the players together created in a
single year inside the game. It turned out to be $2,266 U.S. per
capita. By World Bank rankings, that made EverQuest richer than India,
Bulgaria, or China, and nearly as wealthy as Russia. (by Clive

questio
ns raised about property rights in all of these new virtual game
worlds. Do the laws of the outside world apply? If so, what
country's laws apply? What about the end user license agreement? If
that rules who owns property in the game, then (effectively) that
makes the company law enforcement. So what happens when law
enforcement in the community violates the laws of the nation?
Obviously, these aren't easy questions and eventually they'll end up
in courts.
John has submitted a story about a case in China
where someone is
suing an online game company for deleting a weapon he bought in the
game. Apparently, the seller had "duplicated" the weapon in the
game, which was against the rules. He then sold the duplicate to the
guy suing - and the company deleted it once they realized it was a
duplicate. The guy is suing, saying that he worked hard to make the
virtual cash to buy the virtual sword, and it's unfair for the game to
simply delete it. The company claims that the rules are clear that
dupes aren't allowed - but, only the seller knows it's a dupe. So,
when you unravel it, this is a fairly complex legal question involving
different layers of intellectual property. First, you have the
problems of the "duplicates," which could be seen as infringement on
its own. Then, the guy sold the unauthorized copy for profit
(admittedly within the game, for virtual currency) and kept the
"original". The buyer paid with virtual money and received the
"illegal" copy of the virtual sword which was then deleted. So,
who's really at fault? It certainly sounds like the guy who created
the dupe and sold it is the most reasonable target, but how do you
deal with the situation where the guy then sells the "real" virtual
sword to someone else? Who gets to keep it? The simple answer - of
course - is both of them. It
is virtual property after all,
and can be reproduced at will by the powers that be. However, the
company claims this will destabilize the game. Meanwhile, the guy
who's suing only really has a claim if the virtual property he bought
with virtual money is considered his to own. The gaming company will,
most likely, claim that it's really theirs. It seems like we'll be
seeing plenty of more related lawsuits.

player could

the equivalent wage of a person in Bulgaria by selling the fruits
of his labors on eBay? Well, the same guy appears to have done a more
in-depth study about the "GDP" of the online gaming world and found
that it doesn't quite stack up to Bulgaria, but
has about the
economic impact of Namibia -- though, this ignores the cost of
subscribing to the service, which might cut into the GDP quite a bit.
The article claims that the next country on the list that could be
passed is Jamaica, but according to the
CIA World Factbook, it looks like Namibia is already a few
notches ahead of Jamaica. Plus, the study actually seems to be
looking at GDP per capita (as opposed to overall), in which case the
findings make even less sense. The article claims a GDP per capita in
the gaming world of about $2,000. According to the
World
Facts and Figures list, Namibia's GDP per capita is about $7,100.
Jamaica is about $3,800. When you get down to $2,000, you're talking
about the Federated States of Micronesia.

both in the UK and the US, has been quite successful creating their
own mobile phone carrier, despite not having a network of their own,
but simply handling the branding and management, while leaving all the
technology issues to a network operator partner. So far, most MVNOs
seem to be targeting the youth market (often with "pre-paid plans"),
and considering just how
lucrative
that market seems these days, it's no surprise that plenty of
others want into the market. However, operating the whole MVNO is
probably a lot of work, so now we're getting to the point where you
have
virtual MVNOs (VMVNOs) who will do all the work for a
company, and simply slap their brand on the final product. That seems
to be what's happening with convenience store 7-Eleven, who has
announced plans to
sell pre-paid
mobile phones and service under the "Speak Out" brand - though,
all the work appears to be done by Ztar Mobile. Other retailers are
quickly expected to follow. Wal-Mart is at the top of the list, with
Costco and Home Depot also apparently considering their own mobile
phone offerings. The idea is to target younger users, or those with
bad credit histories, who can simply pick up a phone at the store, and
use it until their minutes run out, at which point they can top it up
again - back at the store, of course.

With innovation, there's a price to be paid, and inevitably, other
manufacturers are going to want a piece of the action, forcing the bar
and the stakes higher as each adds a bit to the original idea.
After all, patents can only go so far, and lawyers can only do so
much.
But the Super shuffle clearly takes the cake.
I mean, the company even borrowed the haphazard placement of Apple’s
earbuds on their homepage.
But let's assume for a moment that the Super shuffle is, indeed, a
real product in development, and it gets past Apple's legal hurdles
and somehow hits the shelves in a conspicuously iPod shuffle-looked
blister case.
I'm willing to be they wouldn’t sell more than a few hundred units.
The Super shuffle is hardly super, adding a voice recorder and an FM
tuner to the existing model. There's still no screen, which makes a
radio mostly useless, and it’s hard to visualize just how recordings
would be started, stopped, played or saved.
And I think that's probably the point of this whole silly venture. If
anyone has ever heard of a company named LuxPro before this silly
imitation, raise your hand.
Anyone? Anyone?
Much like Golden Palace casino buying a $30,000 grilled cheese or U2
filming an gratis iPod commercial, exposure is worth its weight in
gold. And publicity — even negative — is equally valuable.
At CeBIT, when the Super shuffle was publicly unveiled, I’m sure the
LuxPro booth was mobbed with visitors just waiting to get a glimpse of
the device.
After all, the company's other offerings aren't knock-offs and, based
on the field of digital music players that aren't the iPod, they
stacks up fairly well. But with Dell, Napster, Rio and all the others,
it's still difficult for a unknown company to compete in such a
crowded field. But by taking on Apple in such a blatant way, they may
just be on to something.
But you might want to stay away from any Super shuffles auctions on
eBay.
