increasingly rancorous legal controversy over violations of our UNIX
intellectual property contract, and what we assert is the widespread
presence of our copyrighted UNIX code in Linux. These controversies
will rage for at least another 18 months, until our original case
comes to trial. Meanwhile, the issues SCO has raised have become one
of the hottest technology stories of the year, and often our positions
on these issues have been misunderstood or misrepresented. Starting
with this letter, I'd like to explain our positions on the key issues.

toast. But winning will be a tall order. SCO must show that the old,
murky contracts between AT&T (which developed Unix), Novell (which
bought the operating system from AT&T in 1993), and the old Santa
Cruz Operation deliberately transferred the Unix copyrights to the new
SCO Group; it also must show that it owns the rights to derivative
flavors of Unix, like IBM's AIX. Finally, and perhaps most difficult,
SCO must prove IBM and other Linux programmers around the world got
sloppy and ported proprietary code into Linux. Legal experts tracking
the case think each hurdle - let alone all three - is difficult to
clear. The odds are clearly against SCO.

The settlement, which received preliminary approval on July 29, 2004
from the First Judicial District Court for the State of New Mexico,
will make vouchers available to class members that may be used to buy
any manufacturer's desktop, laptop and tablet computers; any software
available for sale to the general public and used with those computer
products; and specified peripheral devices for use with computers. The
total amount of vouchers issued will depend on the number of class
members who claim vouchers, and the maximum value of the vouchers that

versions of the popular iPod digital music player $50 vouchers and
extended service warranties under a tentative settlement in a
class-action lawsuit.
According to AP, lawyers representing consumers in the state court
case said that the settlement could affect as many as 2 million people
nationwide who purchased first-, second- and third-generation iPods
through May 2004. Apple confirmed the settlement but has not
officially commented.
The settlement comes after eight consumers filed a suit in 2003,
alleging that the iPod failed to live up to claims that the
rechargeable battery would last the product's lifetime and play music
continuously for up to 10 hours. According to the terms of the
settlement, people who fill out a claim form are entitled to receive
$50 redeemable toward the purchase of any Apple products or services
except iTunes downloads or iTunes gift certificates.
Consumers will be notified of the tentative settlement in three ways:
by e-mail, by letters, and through advertisements in USA Today and
Parade Magazine in the next month, said Elizabeth C. Pritzker, an
attorney at Burlingame-based law firm Cotchett, Pitre, Simon &
McCarthy LLP, which represented two plaintiffs. Apple has agreed to
pay up to $2.8 million to the two law firms that represented
consumers.

the age of the VC is over, and is getting out of the
business. The specifics of his claim are that VCs won't be able to
earn the same sorts of returns they did in the 90s, which he chalks up
to "systemic change." If anything, it sounds like he's channeling

las Carr, who believes the tech industry is becoming commoditized
and boring (misunderstanding that things first get interesting when
stuff gets commoditized). Of course, the silly thing is that he seems
to be comparing today's VC returns to what you could get in the 90s.
He claims that "the eye-popping returns that make venture capital
famous are history." Of course, the easy response to that is that
perhaps most of the "eye-popping returns" were the aberration in the
first place, built on the bubble of hype-cycles past. That means
there's still plenty of opportunity in
real innovation -- and
even without that, you can bet that there will be more hype cycles and
bubbles.

everyone, good VCs generally are able to make out quite well (since

In all the speculation about the deal I haven't seen what
surely is the motivator. Six Apart plans to go public. The market will
value SA based on it's ability to generate profits, and it will likely
do so in proportion to the number of users, the theory being that they
can sell things to the users, so the more users, the more they can
sell. They might value each user at $100. Anyway, the more users the
more value. LJ has a lot of users. So the founders of LJ get SA stock,
and the shareholders in SA get more users, and value of the combined
companies goes up and the day of the IPO gets closer.
