OK, you Mac users have been telling us this forever, but this is the first time I've seen anyone run the numbers:

A few more details might be useful to understand what really happened in this case, but a woman accused of harassment for sending "e-mails laced with obscenities and references to Adolf Hitler and Osama bin Laden" to a website that had pro-death penalty statements has been cleared, after the judge said she didn't actually break any laws. Since there were just a few emails, they weren't seen as harassing, and since they were just directed to the website in general (which asked for feedback), rather than the individual who specifically received them, the judge determined that they weren't specific threats or harassments. While the ruling makes sense on the free speech side of things, these other arguments don't seem to make as much sense. Just because the website doesn't indicate who the emails are going to, they're still going to someone. Either way, for those of you who enjoy participating in various flame wars, it certainly seems like this ruling says that free speech protects you (at least in this court's jurisdiction) -- assuming you don't become threatening or continue to harass the person.

Yesterday I pointed to a post by Jeremy Zawodny that appeared to be calling for a flame fest with me as the guest of honor. I pointed to it after the first few comments made it clear that it wasn't going to be a flame fest. In fact, it was the most rational discussion of conflict disclosure I've seen to date in the weblog world. It left me bursting with pride to be part of this community.

There's nothing wrong when someone writes an essay advocating something that they have a financial interest in, as long as the interest is disclosed. For example, if you're going to buy a house, it's good to know you're reading something written by someone who will profit if you buy the house. That's why you get an inspector to look over the house after you decide to make an offer. And why you'd feel betrayed if it turned out the inspector was getting a percentage of the sale. (In fact the inspector would go to jail for doing that.)

So when a Google shareholder write's an empassioned defense of Google, it was correct for Zawodny to ask if he was a shareholder. He did ask, and got an answer, and as far as I was concerned, that was news, so I pointed to it. All of this is good, it's the system working as it should.

As I read John Battelle's analysis of search engines, I wonder if he is consulting for the companies he's writing about. John has a long career as a journalist and now as a professor, both professions require disclosures of conflicts of interest, so I assume he has no such conflict, because I haven't seen a disclaimer from him.

On the other hand, I often see people who I know have conflicts writing in their area of conflict without disclosure. In a world where everyone's playing footsie, if you tend to out people, you quickly get a rep for being difficult, or having personality problems. Does this sound familiar? Heh.

In any case, the thread on Zawodny's was a milestone. Thanks to Tara, Brian, Ryan, Randy, Scott and Rogers and the others who stood up and said it's important to know where people are coming from. Tell people when you have a conflict, they'll read you more carefully, they'll respect you more, and the world will be a better place.

Quick announcement:

Anne had lots of Marathon stuff written up (we compose everything offline in Textedit) and the fucking computer locked up. Like a bonehead, I'd forgotten to save it (along with some other important stuff) so it was lost.

I tried cashing in all my computer geek points to resurrect it, but it was DC 45, and all I got was a modified 8.

So that's been set back at least a few days. We both know how many of you guys who supported us and Kris are looking forward to the story wrapping up, but I hope you'll bear with us a little bit longer while our Real Lives take up most of our attention.

Marathon is a testing framework for GUI applications developed using Java/Swing. Marathon composes of recorder, runner and editor. The testscripts are composed of python code. Marathon version 0.84 is released, this contains minor feature enhancement and bugfixes. The details can be found in ChangeLog. Marathon focuses on end-user testing. One need not know Java or Swing to record test scripts using Marathon. Marthon is kept intentionally simple. The aim to produce test scripts that are readable by everyone on the project. I finished the NYRR Holiday Four Mile Run (38:31) this morning and with it completed nine qualifying NYRR races, which means: I've got guaranteed entry into the 2005 NYC Marathon. Yay! As I said to my friend Adriana this morning after the race, "Obviously something's wrong with us if we're waking up to run in 32° weather every weekend for the purpose of gaining entry into a marathon!" Of course, I mean "wrong" in the good sense! I've already got two marathons and one half-marathon scheduled for 2005. Now let's hope my hip injury heals in time.
