Japan's Fair Trade Commission (FTC) has issued a cease-and-desist order against Microsoft Corp, alleging that the United States software giant's restrictive licensing terms imposed on Japanese personal-computer (PC) manufacturers constituted anti-competitive behavior. The provision in question prevents PC makers from claiming patent rights to related technologies against Microsoft or other producers. Japan is the first to allege that the clause violates anti-monopoly law.

Apparently Apple isn't just taking people to court, they're also being sued by an unhappy iTMS customer. It seems Thomas Slattery is being "forced" to buy an iPod if he wants to use the songs he purchased from the iTunes Music Store. Last I checked you could listen to any song from the iTMS either on your PC or burn it to a CD. Truth be told, he could burn it to a CD and then rip it back and listen to it on whatever MP3 player he wanted.

"Apple has unlawfully bundled, tied, and/or leveraged its monopoly in the market for the sale of legal online digital music recordings to thwart competition in the separate market for portable hard drive digital music players, and vice-versa," the suit charged.

To follow this logic is like saying I could sue Microsoft because they don't publish their entire software catalog for Linux or OS X. I'm being "forced" to buy a PC with Windows on it. Should I be able to sue simply because I can't run Access on my Mac? Hmmm... We'll see how Mr. Slattery fares at his attempt before I send lawyers to Redmond.

Cory Doctorow: An iTunes user is suing Apple under US anti-trust laws for locking non-iPod players out of playing back iTunes music.
"Apple has turned an open and interactive standard into an artifice that prevents consumers from using the portable hard drive digital music player of their choice," the lawsuit states...

"Apple has unlawfully bundled, tied, and/or leveraged its monopoly in the market for the sale of legal online digital music recordings to thwart competition in the separate market for portable hard drive digital music players, and vice-versa," the lawsuit said.

Mr Slattery called himself an iTunes customer who "was also forced to purchase an Apple iPod" if he wanted to take his music with him to listen to.

fusebeerbong097.jpg imageApparently Apple's none-too-keen on music video channel Fuse's new outdoor advertisements which mimic the iPod silhouettes campaign, replacing Apple's dancing music fans with people enjoying a nice pull of the beer bong or a casual round of self-pleasuring (suggested word: self-plaguing). The Post is reporting (haha, sorry, "reporting." That just kills me.) that Apple's lawyers have made a few nasty calls Fuse's way, threatening a lawsuit unless the ads are taken down. Adrants has a single ad, but I'm sure our legion of subway-riding readers can play the cameraphone tip to send us in the rest of the ads.

And as our buddy Plywood pointed out, Toronto's Flow 93.5 FM had an award-winning silhouette campaign about, oh, two years before the iPod campaign. (Thanks, gruverja!)

  • Washington Post: Legalizing Torture. The Bush administration assures the country, and the world, that it is complying with U.S. and international laws banning torture and maltreatment of prisoners. But, breaking with a practice of openness that had lasted for decades, it has classified as secret and refused to disclose the techniques of interrogation it is using on foreign detainees at U.S. prisons at Guantanamo Bay and in Afghanistan and Iraq. This is a matter of grave concern because the use of some of the methods that have been reported in the press is regarded by independent experts as well as some of the Pentagon's legal professionals as illegal. The administration has responded that its civilian lawyers have certified its methods as proper -- but it has refused to disclose, or even provide to Congress, the justifying opinions and memos.
  • The Bush administration believes that law -- domestic and international -- is what the Bush administration says it is. Now we have lawyers' justification for torture, but under a less harsh name. I keep wondering what so-called conservatives would be saying if Bill Clinton had asserted such sweeping powers in this and other ways, or had consistently stiffed the Congress and American people with secrecy and arrogance. My guess is they'd be insisting that the law, or maybe even national honor, should mean something. Not this crowd.
