It's actually somewhat surprising we don't hear more stories like this. Yahoo Japan has an online auction service, and just like every online auction service, some scammers use it to pull the old "sell something you don't have" trick. Of course, the people who are fault are the scammers -- but upset scam victims apparently figured they need to look somewhere else to sue, and the obvious choice is Yahoo Japan. So, despite just being the platform for the auctions, there's now a class action lawsuit against Yahoo Japan because some scammers used the auction site. This is going to be a very difficult case for those suing to prove. It's not Yahoo's fault -- even though the lawsuit claims that Yahoo somehow knew these auctions were fraudulent. This is yet another case where people sue the big company, rather than suing whoever actually broke the law.

Last month, a company named BTG announced that they held the "worldwide licensing rights" for a patent on automatic updates over the internet -- and (of course) they expected everyone to pay up, including Microsoft. Well, it appears that the Microsoft lawyers laughed them out of the room, so now BTG has been forced to sue both Microsoft and Apple for violating patent 6,557,054 on "A method and system for distributing updates by presenting directory of software available for user installation that is not already installed on user station." And people still think our patent system works great? The patent was applied for in April of 2000. There must be a ridiculous amount of prior art of applications that updated themselves prior to that.

Using Mac OS X's Software Update system preferences pane to update your operating system and Apple-made applications could become a thing of the past, if a lawsuit pending against Apple Computer Inc. and Microsoft Corp. gets its way. Both companies have been named as defendants in a lawsuit recently filed in the Federal Court for the Northern District of California. The plaintiff in the case is Teleshuttle Technologies LLC. The suit alleges that Apple and Microsoft are infringing a patent that covers online software updates.

The latest in an incredibly long line of silly patent lawsuits comes from BTG (who already has a series of silly patent lawsuits against Microsoft and Apple for a patent on "updates over the internet), who is suing Amazon, Barnes & Noble, Netflix and Overstock for violat ing their patent on tracking the path a visitor takes through their websites. Once again, you have to wonder how this could ever have been approved as a patent. Looking at the actual patent, it seems likely that just about anyone who uses any kind of advanced log file analysis software probably violates this patent. How dare you analyze how visitors use your site without paying extra!
