09/27/2004 12:33 AMUS Federal law requires that phone companies etc make available
provisions so Law enforcement can wiretap lines when they have a court
order. Currently their are no provisions or if their are they are not
being talked about for Law enforcement to tap VOIP conversations.
I imagine that those that are involved in criminal activity are
smart enough to realize this and are probably exploiting the
technology. With all of the data transmission methods now though I
wonder at what point does it become unfeasible for law enforcement to
do their job properly. Kind of scary but all we can hope is that they
at least attempt to keep up with technology to protect the citizens of

providers will be able to remain free from state regulation. The final
decision was rendered in thanks by the U.S. Court of Appeals for the
Eighth Circuit in St. Louis. It seems that their ability to escape the
potential regulation comes from the simple fact that VoIP is not
considered to be a true telephone service….

toward increased web surveillance:
[T]wo recent legal developments have raised further fears among Web
privacy advocates in the United States. In one case, the Federal
Communications Commission voted 5-0 last week to prohibit businesses
from offering broadband or Internet phone service unless they provide
Uncle Sam with backdoors for wiretapping access. And in a separate
decision last month, a federal appeals court decided that e-mail and
other electronic communications are not protected under a strict
reading of wiretap laws. Taken together, these decisions may make it
both legally and technologically easier to wiretap Internet
communications, some legal experts told NEWSWEEK. "All the trends are
toward easier to tap," says Kevin Bankston, an attorney at the
nonprofit Electronic Frontier Foundation.
The FCC's plans to require Internet-based phone and broadband services
to be engineered for easy wiretapping is a response to a request from
the FBI and other law-enforcement agencies. The proposal would bring
Internet-based phone providers in line with the Communications
Assistance for Law Enforcement Act (CALEA), which requires
"telecommunications" carriers to make their networks wiretap-friendly.
The FCC says the government must still go through all of the necessary
legal steps to obtain the authority to wiretap; CALEA simply makes it
technologically easier to do. "This will not have an effect on whether
there is appropriate lawful authority -- that remains the same," says
FCC spokesman Julius Knapp. "All this really is addressing is whether
the carrier is required to have the capability to provide the
information that's covered by a court order."

01/23/2004 02:23 PMThere was a conference yesterday all about the CAN-SPAM law, where
speakers took turns either
bashing the
law for being a total failure - or telling people how to comply with
it. Of course, for the most part, the people looking to comply
with it, aren't spammers - but companies that already send out emails
and are suddenly afraid that they're going to get in trouble. The
article also mentions (thankfully!) that just because you comply with
CAN-SPAM it doesn't mean you should spam people. Though, the
reasoning presented was a little suspect. They point out that if
Nordstrom's spammed people, all anti-spam programs would block them
and they would have killed off email as a marketing channel. That's
true. However, a much better point would have been that if they had
gone and spammed people, many people would be incredibly pissed off at
Nordstrom's - and, generally speaking, pissing off everyone you're
trying to market to isn't the greatest technique for building a
sustainable business. In the meantime, the FTC still won't say what
they're doing to enforce CAN SPAM, and my spam count keeps going up.
