For years I have run a BBS (Bulletin Board Service) and have been a member of the Trialware Professional Association. That website at current count has allowed on my dime the download of 85,632,109 Shareware Programs. That is in a 15 year time spread from the days of dial-up systems to modern Internet based BBS systems.

So what do I get in e-mail today from the TPA

Apparently this is some new policy in place like I really knew that this was part of their mission statment. I probably visit there site like once a year. It is obvious that shareware authors are getting sensitive to the word SHAREWARE. Here is what I am going to do I will systematically remove every TPA members files from my website and never again will I apply to be a TPA member. Getting all upset over the word SHAREWARE, hello. Probably the website administrator was still wearing diapers when the term was coined.

When his wife tried to cancel his mobile phone service, she was told she needed to pay the "early termination" fee. Early termination, indeed. With all the hype over VoIP, Om Malik is pointing to one thing that has the potential to seriously damage many VoIP providers' plans. The FCC might deny Level 3's petition to be exempt from termination charges (though, they may add further exemptions as well). The issue here is that the VoIP providers don't pay termination fees to telcos for calls that end up on their network. The telcos, obviously, would like them to pay up -- which would significantly increase the costs for VoIP providers, in turn increasing the fees for VoIP service, taking away much of the "benefit" from the existing sales pitch. Of course, it's not clear the FCC would actually let it get that far, but there's obviously room to be concerned. Once again, you have to wonder why the VoIP providers don't open up their networks and build a developer community. Letting those developers come up with useful apps would create value beyond just "cheaper phone service."

We very quietly reached another goal this week. Since I started this site almost three years ago, I've wanted to have as many comments as I had entries. I don't know why, it just seemed like a good goal to have.

The first iteration of the site was a custom PHP app that didn't even have comments, so we got a late start. We flirted with the goal for the last few weeks, but it doesn't help that we're posting like chipmunks on crack these days. I'm also really anal-retentive about the comments — there are no spams, "me toos," or test comments in the database. All comments are legit.

Anyway, comments passed up entries on Sunday. As I write this, we have 2,909 entries and 2,938 comments. Next goal: 3,000 entries, which we'll hit by the end of the month. The ultimate goal has always been 5,000 entries, and we're on a pace to hit that by the end of next year.

Apple is offering consumers who had battery problems with older versions of the popular iPod digital music player $50 vouchers and extended service warranties under a tentative settlement in a class-action lawsuit. According to AP, lawyers representing consumers in the state court case said that the settlement could affect as many as 2 million people nationwide who purchased first-, second- and third-generation iPods through May 2004. Apple confirmed the settlement but has not officially commented. The settlement comes after eight consumers filed a suit in 2003, alleging that the iPod failed to live up to claims that the rechargeable battery would last the product's lifetime and play music continuously for up to 10 hours. According to the terms of the settlement, people who fill out a claim form are entitled to receive $50 redeemable toward the purchase of any Apple products or services except iTunes downloads or iTunes gift certificates. Consumers will be notified of the tentative settlement in three ways: by e-mail, by letters, and through advertisements in USA Today and Parade Magazine in the next month, said Elizabeth C. Pritzker, an attorney at Burlingame-based law firm Cotchett, Pitre, Simon & McCarthy LLP, which represented two plaintiffs. Apple has agreed to pay up to $2.8 million to the two law firms that represented consumers.
