While this article is focused on things in the UK, the idea equally applies here in the US where the FCC has suddenly gone on high alert trying to "clean up" the airwaves. The idea is that if broadcast companies started sending additional content to TiVo or TiVo-like PVR devices that could fit around the show, but never actually be broadcast on television, there's no reason that that the additional content needs to abide by regulations. So, in the article linked here, it talks about advertisements for beer and cars that don't need to meet specific (very strict) advertising laws in the UK. In the US, you could (in theory) include additional "too hot for broadcast TV" content that could easily be slotted in to programs viewed on a PVR. Of course, as with any kind of loophole, it's only a matter of time before lawmakers with too much time on their hands decide to close it.

There have been studies in the past that showed that TiVo (or similar DVR users) often can recall the commercials they've fast forwarded through. Now, Dave Pell from Davenetics points us to a new study that actually suggests DVR users see more commercials - even though they're just fast forwarding through them. Basically, the people most likely to have and use a DVR device are the same people who were likely to simply channel surf when commercial came on in the past - meaning they saw very few commercials. Now, however, while they may be fast forwarding through the commercials, they are still at least "seeing" them - and possibly getting some brand recognition. In fact, the survey suggests the net impact of advertising on DVR users may be positive. Of course, it might help if broadcasters and advertisers continued to look at more creative advertising solutions. As Dave suggests, "The first advertiser to shoot commercials in slow motion wins."

It looks like TiVo is finally catching on. While Nielsen had planned to start including data on people using TiVo-like devices in 2006, they're now pushing that deadline up a year, as they've noticed that the TV-watching public is increasingly signing up for such services (thanks, in part, to various cable and satellite providers offering them with basic service). For the extra paranoid, Nielsen says they won't track things like whether or not people fast forward through commercials, but only whether or not the show was watched at a different time than it was originally broadcast. Still, it probably won't be long before they're tracking commercial skippers as well. So the question is, once the data on commercial skippers becomes public, what will happen? Will broadcasters demand changes in the technology (or the law!), or will they admit that it's time that they, themselves, changed how they present advertising (or, even, how they fund their operations)?

TiVo Inc., maker of popular digital television recording devices, on Wednesday received approval for technology that would permit users to send copies of digital broadcast shows over the Internet to a limited number of friends.

The Federal Communications Commission voted to certify digital protections on TiVoToGo, which is not yet available but would enable a user to record and send a digital broadcast television show to up to nine others who have been registered on that person's service and has been given a key to see it. The approval came despite concerns by the Motion Picture Association of America (MPAA) and the National Football League about the risks of unfettered distribution of copyrighted shows and airing regional games outside of their market.

"Each of these technologies has been exhaustively reviewed to ensure contention protection systems prevent the mass indiscriminate redistribution of digital television programming," said FCC Commissioner Jonathan Adelstein. The FCC last year adopted rules to limit distribution of digital, over-the-air television programs over the Internet in an effort to prevent mass illegal copying and sharing, a problem plaguing the music industry.

Just after we wrote about how TV needed to better integrate with broadband services and just as DirecTV sold their entire stake in TiVo in order to build their own competitive offering - TiVo is announcing plans to better tie their service to the internet - letting users download additional content from the internet. There aren't many details so far, but it sounds like they're basically going to copy Akimbo's plan and try to route around broadcasters by letting users download content directly from the internet. While this has some benefits (and it would be cool if they added some broadca tching style features), it also may raise issues. There's still a question about how much viable content there is that would be offered over such a service. Will traditional providers be willing to provide content if they think it may harm their traditional channel? More importantly, broadband providers still don't want people downloading such huge files all the time. Even if it's completely legal, having users constantly downloading video programming may force broadband providers to rethink their offerings and become more aggressive in enforcing usage caps.

tivO_streaming.jpg imageSo this article in the Times about TiVo's plans to provide on-demand television streaming is almost real news, because it does finally confirm what exactly TiVo's plan is to save itself from obscurity. What it doesn't say, though, is how much it will cost and what content it will provide, meaning for now that this is just every other video-over-the-internet companies out there that promise big things and end up never getting off the ground.

If I could pay Netflix-style pricing for television shows, though, I would be all over it. Imagine being able to queue up a Season Pass for a show and then purchase and download the episodes your TiVo hadn't gotten to yet. But I'm sure as shootin' not paying DVD rental prices for low-resolution television programs. Developing!
