Taking A Picture Of A Band Violates
Their Rights?
08/05/2004 05:18 AM

Well here's a story that combines the insanity over camera phones with the insanity over intellectual property. First pointed out by Tim Wu who found people being turned away at an RIAA sponsored concert at the DNC, apparently many clubs are now banning camera phones in the clubs because the bands are afraid their images will end up on eBay and they won't get any cash for it. Seriously. Apparently, we've reached such a level of greed that all common sense has gone out the window.

WhenU Violates Own Privacy Policy 05/27/2004 12:09 PM
??Edelman?s research, detailed here, demonstrated that the transmissions back to WhenU?s servers include the web site URL being visited when a WhenU ad was displayed on the user?s system as well as other data. This seemed to contradict the then-current WhenU privacy policy statement that as ?the user surfs the Internet, URLS visited by the user (i.e., the user?s ?clickstream data?) are NOT transmitted to WhenU.com or any third party server.? And it unquestionably contradicts privacy promises WhenU makes in places where there is at least some chance ?customers? will see them before they are inflicted with the company?s software.?

Web Violates Bryant Accuser's Privacy

Web Violates Bryant Accuser's Privacy 07/20/2004 11:28 AM

Bry ant accuser asks judge to stop posting court documents: Some interesting privacy implications in the Kobe Bryant case.

The attorney for the woman accusing NBA star Kobe Bryant of rape on Monday urged the judge to stop posting court documents on the Web, saying she and her family are concerned about her safety.

[... her attorney] said mistakes by court staff have put his client in danger. He cited the inadvertent posting of her name in an online document earlier this year and the accidental e-mail of closed-door hearing details to a handful of news organizations last month.

Mistakes in online content are directly proportionate to how easy it is to post content (see this post for a similar theme).

131 words from On Bullshit violates
copyright? Bullshit! -- UPDATED
03/17/2005 03:56 AM
Cory Doctorow: A reader writes, "Much-blogged 'On Bullshit' essayist Harry Frankfurt, of Princeton's philosophy department, has asked me to pull a 131-word excerpt from his essay from my blog, saying that it'll hurt his profits. Has the guy--an academic, no less--never used quotation in his work? Never heard of fair use?"

Here's 131 words from On Bullshit for your perusal. In my view, the claim that this is either a "clear infringement" of copyright or will displace sales of the book is so unlikely as to constitute bullshit.

One of the most salient features of our culture is that there is so much bullshit. Everyone knows this. Each of us contributes his share. But we tend to take the situation for granted. Most people are rather confident of their ability to recognize bullshit and to avoid being taken in by it. So the phenomenon has not aroused much deliberate concern, or attracted much sustained inquiry. In consequence, we have no clear understanding of what bullshit is, why there is so much of it, or what functions it serves. And we lack a conscientiously developed appreciation of what it means to us. In other words, we have no theory. I propose to begin the development of a theoretical understanding of bullshit, mainly by providing some tentative and exploratory philosophical analysis.

Update: Paul sez, "It seems Harry Frankfurt isn't a copyright monster, but just a bit confused. He emailed me the following. If you wouldn't mind doing an update..."

Dear Mr. Schmelzer,

I've looked at your site, and I have no objection to the excerpt from my essay that is presented there. I apologize for any suggestion that you might have done something improper. Indeed, I am grateful to you for the honor that your attention to my work does me.

Harry Frankfurt

C-BAND=BS 07/08/2004 10:48 AM
On September 24 2001, stock in Stewart Kaiser's start-up company R-Tec was selling for 46 cents a share. That day, Kaiser issued a press release about R-Tec's new device called C-BAND (Chemical & Biological Alarm and Neutralization Defense System.) Four days later, R-Tec shares had risen to $2.40 each and Kaiser sold the 50,000 shares he had just given to his mother. The funny thing is that C-BAND was actually nothing more than a filing cabinet painted yellow and outfitted with a flashing red light. Today, Kaiser and his wife were indicted for securities fraud, obstructing justice, and other bad things. Link

Band
09/14/2004 03:48 AM
Xeni Jardin: During the "iPod Beemer" episode I did last week on the NPR show "Day to Day," I played a couple examples of the kinds of tunes you could rock out to in your iPodified BMW convertible -- one of them was "Early in the Morning," by legendary '80s R+B icons The Gap Band. During that episode, host Noah Adams inadvertently dissed the Gap Band. When he heard that segment air, my D2D colleague Brian Unger vowed to settle the score of funk: he challenged Mr. Adams to a duel, and here is the result. Listen to Brian's segment "Don't Diss The Gap Band" -- Link

Update: BoingBoing reader Mike Ransom of Tulsa Oklahoma says, "The GAP Band was named after three streets here in Tulsa: Greenwood, Archer and Pine. That's the same Greenwood and Archer mentioned in the archetypical Bob Wills Western Swing tune, "Take Me Back To Tulsa". Here's a further bit of trivia about one of those streets -- Link. The story above is done in the style of Paul Harvey, a Tulsa native. Here is a morph I did of Paul Harvey from his high school yearbook picture -- Link."

Maggot Band-Aid

Maggot Band-Aid 09/16/2004 09:29 AM
David Pescovitz: First used centuries ago to treat battlefield wounds, maggots are proving to be a useful treatment to prevent post-operative infections. Maggot debridement therapy (MDT) calls for maggot dressing to be applied to wounds twice a week for up to 72 hours each time. From the press release about a recent study on MDT in the journal Clinical Infectious Diseases:
"Debridement, or the removal of contaminated tissue to expose healthy tissue, can be done surgically. However, maggots that have been disinfected during the egg stage so that they don’t carry bacteria into the wound have their advantages. The larvae preferentially consume dead tissue (steering clear of live), they excrete an antibacterial agent, and they stimulate wound healing--all factors that could be linked to the lower occurrence of infection in maggot-treated wounds."
