09/10/2004 01:18 PMWe've written before about a Pennsylvania law that
require
d ISPs to block anyone from accessing child porn. There were
obvious problems with this law. It's good that Pennsylvania wants to
stop child porn, but putting the burden on the ISPs is the wrong way
to go. ISPs, of course, are just the pipe. They shouldn't have to
worry about what their users are, or are not, accessing. It was also
problematic that Pennsylvania was using a ban-list that no one was
allowed to review to make sure it was fair. The biggest problem,
however, was that ISPs blocking sites ended up blocking other,
perfectly legitimate sites that were simply hosted on shared servers.
Now, a federal judge has decided that's simply too big a cost and
has said the law
needs to go. What still doesn't make sense, is that if
Pennsylvania was able to identify all of these child porn sites, why
were they wasting time getting ISPs to block them, rather than going
after those who were actually
responsible for running and
hosting the sites, and get them taken down that way?

is running a patent-busting contest:
We're currently seeking nominations for ten patents that deserve to be
revoked because they are invalid. Sadly, we don't have the resources
to challenge every stupid patent out there. In order to qualify for
our ten most-wanted list, a patent must be software or
Internet-related and there must be a good reason to suspect that the
patent claims are invalid. We're especially interested in patents that
target tools of free expression, such as streaming media, blogging
tools, and voice over IP (VoIP) technology. Most importantly, the
patent-holder must be aggressively enforcing its patent and suing (or
threatening to sue) alleged infringers. We're particularly interested
in cases where the patent-holder is trying to force small businesses,
individuals, nonprofits, and consumers to pay licensing fees. Deadline
to enter is June 23.
On June 30, the Patent Busting Project's team of tough lawyers and
brainy geeks will announce the contest winners – or losers,
depending on how you look at it. And that's when the real fight for
great justice begins. We'll be needing your help to research prior art
for each patent and offer your technical expertise or historical
knowledge. Using a legal process called "reexamination," the Patent
Busting Project will ultimately go to the US Patent and Trademark
Office (USPTO) and attempt to take those bad patents off the books.

general perception of who is surfing porn sites,
one-third of porn site visitors are women. The article
doesn't go into details, so it's unclear how they defined "porn sites"
and how they measured this. They do quote one woman who claims that
"you can get both education and inspiration" from the sites. So,
maybe that's the defense schools and libraries should use for not
filtering the internet: it's "educational" (yes, I'm joking). Anyway,
I don't think it's all that surprising that there are women who like
porn (studies have shown that before), but I'd say the details of the
study need to be explained a bit more before people go jumping to
conclusions.
