A software company is now suing Symantec for calling their product adware. They claim that they've lost business, lost distributors and can't advertise on Google due to this. The product they're offering claims to be a spyware removal tool, but the same company also offers "email marketing" and other advertising services, so it does make you wonder.

WhenU, one of the more well known adware companies has filed a lawsuit to block Utah's anti-spamware law, claiming that it restricts their constitutional rights to advertise. While a lot of companies have been fighting against the bill, a number of careful reads through the law have pointed out that it actually seems to do a pretty good job of defining spyware. It basically prevents software from sending info home without making this fact clear to the end user or providing them with an easy way to uninstall the software. In fighting the law, most companies have been fairly vague in explaining just what legitimate software would be made illegal. The main issue is really just the notion of informing users that their data will be sent somewhere - and it's tough to come up with a good reason why the users shouldn't be informed. As far as I can tell, those fighting against the law are basically admitting that they want to secretly record your info and send it off somewhere.

It seems that the latest strategic thinking from the folks at AOL is that, now that people are leaving the paid for service in droves, they might as well do everything possible to drive people away from their free offerings as well. How else can you explain their decision to install additional spyware/adware with the latest version of the AIM instant messenger product? As Broadband Reports points out, they apparently didn't learn anything from Real Networks latest problems. If they keep this up they'll (just like so many others) drive people to Microsoft and Yahoo (and Google, once they add their own Gimmle, or whatever Google's eventual instant messenger product will be called). The response, of course, is that AOL needs to make money somehow, and while that's true, that doesn't mean the way to make money is to piss off your user base. I'm not sure what gets into people's heads that they believe the only way for advertising to work is to piss off people. In a competitive market, that's just like handing your users over to your competitor.

WeatherBug made it a point to explain why they do not consider themselves to be spyware nor adware. While my feelings on the matter differ, the WeatherBug rep went to great lengths to explain that he and his team are committed to the prevention of such annoyances as spyware and promises that WeatherBug will not install any on our PCs. If this is in fact true, then this is great news. Personally, I have found another product that more than meets my needs.

Seems I am not the only one that has been dealing with more PC's inundated with Spyware and Adware. I explained in earlier articles that my kids computers are loaded with all the software to fight the intruders. Unfortunately I usually have to slick the drive every 90 days or so because they click on something that gets through the digital blockade I have erected. Thank God for Norton Ghost as it makes recovers real easy.

It appears that Yahoo heard the backlash loud and clear a few months back when they released an anti-spyware tool that just so happened to skip over adware from Yahoo partners. The latest version, built on PestPatrol's technology will now default to notifying users of both "spyware" and what they consider to be "adware" and then give the user the choice of what to do. I haven't tested the product yet, but it sounds like they're moving in the right direction. It still makes you wonder what they were thinking in offering a purposely crippled offering. People know what spyware is, and telling them that spyware isn't spyware doesn't change how people feel about it. It also doesn't make them look kindly back at the company that provided them with the bogus anti-spyware tool in the first place.

We didn't write about Yahoo's new "anti-spyware" toolbar that they announced last week, because it seemed to receive plenty of hype, and there were no real reviews of how it worked. There are so many so-called anti-spyware applications out there that don't actually stop spyware and adware for fear of upsetting marketing companies or out of worries that actually stopping spyware may make some applications stop working (upsetting the user), that we figured Yahoo's anti-spyware app (hype and all) probably wouldn't be much to bother with. It certainly looks like that may be the case. eWeek is now reporting that Yahoo tries to dance the careful dance of not upsetting certain companies who threate n to sue people who call their application spyware. Of course, the situation is even more complex because Claria (who you probably know as Gator - despite their attempt to change their name to shake that spyware label) is also a partner of Yahoo. So, it's really not surprising that the default setting for Yahoo's anti-spyware app won't actually remove services like Gator or WhenU. Instead, Yahoo's spyware remover claims these programs are "adware" and will only remove them if you click and extra check box each time you run the program. In other words, once again, you can't trust a provider of anti-spyware software, because they're playing both sides of the fence: partnering with providers on the one hand, and then offering weak removal products on the other. If Yahoo were serious about removing spyware from the computers of users they would refuse to partner with companies that used surreptitious tactics to be installed on computers. Instead, they want to look good to users in the front, while letting in spyware/adware from partners through the backdoor.

Unfortunately, when it comes to spyware/adware, there are two separate issues that often get confused. First, is the fact that the spyware is often installed without the user's knowledge or consent and is nearly impossible to remove. Second, is the fact that the application watches what you do, sends it back to a central server tracking info about you and pops up ads competing with sites you're viewing. It's important to separate out these two issues, because if the first issue wasn't there, the second one wouldn't be a problem. If someone wanted their information tracked for the sake of getting targeted ads, that should be up to them (no matter how ridiculous it seems to the rest of us). Unfortunately, though, most of the lawsuits targeting spyware companies have been about the second issue, where other companies are upset that ads are shown over their sites. While the courts don't always agree, many have realized that this practice, by itself, is perfectly legal (and is the same as things like your super market printing out a coupon for a competing product to one you just bought). The real problem is the fact that most of these products are installed without permission or by tricking the user into giving permission without realizing what they're doing. However, according to Broadband Reports, some people have finally filed a class action suit against one of the worst offenders of the sneaky install. The claim is that the company, Direct Revenue (who has a reputation for layer upon layer of dirty tricks despite claiming to be "transparent" with users), is unlawfully using and damaging many computers to make money "while willfully disregarding the computer owners' rights to use and enjoy their personal property." If this case gets anywhere (perhaps a big "if") it could threaten many of the adware companies out there, who all claim transparency, but have been shown repeatedly to use surreptitious installs. Of course, they'll probably all just blame it on their affiliates.
