Scamming Software Company Scams Again

Scamming Software Company Scams Again 09/03/2004 06:19 PM
You may recall Bonzi software as the company that used to run pop-up ads trying to trick you into thinking there was something wrong with your computer. They eventually settled a lawsuit about those ads, but were dinged again earlier year for knowingly collecting data from children under 13 via their BonziBuddy product (as the article notes, the data they collected included the birthdate of the children making the "knowingly part a slam dunk"). It appears that neither previous case is going to keep Bonzi from staying on the legal side of their advertising practices, as they've now settled yet another case brought by the FTC for false advertising about their "anti-phishing, anti-virus" product that, in truth, does very little. However, that doesn't stop their advertisements from first telling you that all of your personal information can be taken by thieves, and that their software will protect you completely from the threat. Isn't there some sort of three strikes law for scamming companies?

Congrats Hollywood: You Put A Useful
Software Company Out Of Business

Hollywood must be thrilled. We've been following the case of 321 Software for nearly two years, and that story is now over. 321 made software that was designed to make backing up your DVDs easier. Fair use laws are clear that people are allowed to make personal backup copies of digital media for themselves, mainly if a product breaks or has problems. 321 was careful to make sure the product was really only useful for that purpose, and that it wasn't a very good tool for anyone who wanted to make many copies of a DVD. The company even put out a bounty< /a> if anyone could find someone who was pirating DVDs with their software. Still, the movie industry attacked, and claimed that the software would harm "consumer choice and film making" without giving any evidence how that might happen. Eventually, Hollywood's lawyers prevailed, and 321 was told to stop selling their software. The company kept trying to fight the ruling, but without being able to sell software it's tough to do much, and today the company officially shut down. While Jack Valenti was telling us that if this software was allowed to exist we'd have less consumer choice, it appears that that's the case now, since we can no longer buy this software and back up our DVDs.

In Brief: Siemens acquires IPTV software
company Myrio
04/08/2005 10:07 AM
German electronics giant Siemens has reached an agreement to acquire U.S. software company Myrio, which specializes in technology for providing TV service over the Net. Myrio provides middleware and applications for emerging IPTV (Internet Protocol TV) services that use the Internet -- and not broadcast towers or satellites -- to deliver video into consumers' homes. The acquisition will help strengthen Siemens' portfolio of so-called "triple-play" voice, data, and video technologies aimed at network operators, ISPs, and cable companies. Numerous players in the telecoms sector see strong growth potential in providing services such as interactive TV and TV on demand, in addition to telephony and high-speed Internet access. The terms of the deal with the privately held company were not disclosed. Myrio, a 75-person software company, began life as an ISP, formerly called SourceNet. The company later changed its name and focus, moving into the development of software to provide video over IP.

I've got a ton of backlogged stuff to post about, links and comments, both from D and elsewhere. So tonight, I've decided that, rather than try to perfect little posts on things, I'm just gonna start posting stuff in a random flood. Which is sort of what blogs are meant for anyway. I'm still fighting the decades of training in linearity!
