The fact that Time Warner is looking to add a mobile phone solution (via an MVNO arrangement) isn't a surprise. They mentioned it in March, confirmed it in June and talked more seriously about it in November. So, it's not entirely clear why everyone is making a big deal out of the fact that the company is now talking to Sprint about using their network. Sprint, of course, has jumped into the MVNO market in a big way, providing the network for most of these new offerings, from Virgin Mobile to the new ESPN mobile phone offering. It's also not surprising that cable companies are looking to add a mobile phone solution -- that too many people are calling a "quadruple play," when it's really more about making the triple play mobile. However, what's more interesting is that it finally appears that other carriers are waking up to the possibilities of the MVNO market. While lots of people picked up on the fact that T-Mobile USA wasn't looking to team up with any other carrier, it didn't receive quite as much attention that part of their strategy to stay relevant is to offer their network to cable companies in an MVNO-style relationship. For all of those who were afraid that the Sprint-Nextel merger was going to mean less competition, the market is rapidly filling up with new companies who are simply using existing networks to offer service. While it does raise questions about the network provider competing with its own virtual operators, it looks like there's still going to be plenty of competition.

As cable companies continue to look for ways to differentiate themselves from telcos and satellite TV providers, it looks like the next big area many are exploring is adding interactive video games to your television set. It's a fairly simple idea. They're not looking to compete with consoles, but are more focused on casual games like poker. This is probably a smart move. Obviously, the set top boxes that deliver these games don't have the processing power of dedicated gaming consoles, but those simple casual games are often the most addictive. At the same time, the cable companies are highlighting the fact that users can easily play against each other -- something that satellite providers would be hard pressed to mimic. While this seems like a small thing, there are a few things that are impressive about it: (1) The cable companies aren't charging for this. They realize that it doesn't really cost them anything, but could help reduce churn or entice new customers while providing yet another feature they can claim differentiates them from telcos (for now). (2) They're hoping to let it expand beyond just the television -- and want to work out ways where you could start a game on your television, but continue it later on your computer or your phone. In other words, they recognize that they can't just lock people into the TV, but have to provide a seamless way to pass the experience across multiple platforms.

It looks like patent hoarding company Acacia is getting a bit cocky these days. Last year, the company made a lot of news for getting a questionable patent on "streaming media" and then suing porn sites, since they knew people wouldn't pay as much attention to them. Many sites felt the need to pay up, and Acacia used that war chest to go after bigger companies like Disney. Along the way, they got all excited because a judge upheld their patent rights - but only because no one showed up to contest them. These wins seem to have made Acacia cocky, and they've now decided that any company offering video on demand over cable or satellite services are also violating their patents. Thus, they've sued Comcast, Cox, Charter, DirecTV and EchoStar for violating the patents. These are companies that have a lot of money, and hopefully at least a few of them will stand up to this blatant patent extortion. People have been talking about video-on-demand service for ages. It's not a new concept, and it's unclear (again) how this helps innovation in anyway. Right now, it only looks like it's going to make video-on-demand services more expensive. In fact, Acacia will even tell you how much more expensive: they want $1.25 for every digital cable subscriber with video-on-demand, $1 for every digital cable TV subscriber and $0.50 for every analog cable TV subscriber. If they win, expect to see these charges added to your next bill. Apparently, higher bills count as innovation these days.

OK here is some good news from the digital divide that puts some of the tech industries biggest players on the side of consumers in supporting the Digital Media Consumers' Rights Act which is also referred to HR 107 which I have been advocating that you support. I am continuing to encourage you to write to your Congressional Representative to help get this bill approved. HR 107 will change wording in the Digital Millennium Copyright Act that will assure consumers fair use of digital media.

Of course the MPAA, RIAA and other organizations want those provisions of the DMCA that HR 107 changes left as they are so that encryption and lockout tools can be incorporated into digital recording devices.

It is nice to see public companies working behind the political scenes in Washington DC forming a coalitions that supports the consumer. [Cn et]

Details are sketchy, but New York City may allow six telecom firms to pay up to $25 million per year to install wireless transmitters on 18,000 lamp posts: The article is full of sturm und drang about health effects, but the real story is that the city is trying to counter its dead zones without tearing up the streets. It's unclear precisely what kind of transmitters these will be, but you can bet your boppy that the goal will be wireless backhaul for the majority of the points using mesh or simple point-to-point. This endeavor could bring massively improved voice, 2.5G/3G cell data, and Wi-Fi into a city without ripping up all the roads once again or putting giant cell antennas on every last building. The companies include well-known and never-heard-of-'em: the New York Post says they are two cellular providers, Nextel and T-Mobile, three non-cellular companies, ClearLinx Network Corp., Crown Castle Solutions, and Dianet Communications. In mid-December, I mentioned BrainShare in passing fully meaning to get back to a newsletter devoted to Novell's annual users' conference sometime in early January. But events, other topics (and, I must admit, my own faulty memory) have put it off until now. Here's the scenario: Run any application on any OS on any type of processor with no performance hit. Sounds like a dream, right? Linux apps on Windows, Mac apps on Linux, Intel codebase on a PowerPC chipset... Impossible!

Not according to Silicon Valley startup, Transative Corp. They claim their QuickTransit software will allow applications to run transparently on multiple hardware platforms including Mac, PC, mainframes and servers with no user intervention and almost no performance hit.

The company claims QuickTransit eliminates the need to port software from one platform to another. Software applications written for one platform will run on almost any other, without any modifications to the underlying program.

"This opens up a whole new world of things you can do, because previously software was tied to (a) particular processor," said president and CEO Bob Wiederhold. "It gives you access to a much greater diversity of software. One of the key breakthroughs is performance. You can't tell the difference between a translated application and a native application."

"It's pretty darn impressive," said analyst Jim Turley. "It's remarkable because it's unremarkable (to see it in action): It just works." Turley said he watched a Windows laptop running the Gimp image editor for Linux. The software quickly and efficiently performed a series of processor-intensive graphics transformations and effects, Turley said. "There was no performance hit," he said. "I was expecting a lag, some symptom that things were not as they should be, but that was not the case. There was no hand-eye delay. It seemed completely normal. It responded really quickly."

It looks like Adelphia cable broadband customers who are about to get shifted over to Comcast have plenty of outages to look forward to. The same evening that it's announced that Time Warner and Comcast will jointly devour what's left of Adelphia for about $18 billion, Comcast had major DNS issues leaving many of their users offline. Of course, in explaining the widespread outage, Comcast is using their favorite phrase: "scheduled maintenance." That's the same thing they told me when Comcast turned off my service nearly every weekday last October. I would call every morning and be told that it was "scheduled maintenance." However, when I asked what the schedule was and if I'd have service the next day, I was told they had no idea. Apparently, it doesn't become scheduled until it actually cut you off.

Last week, we noted that Comcast was having widespread outage problems, which they chalk ed up to "scheduled maintenance", even though no one was actually informed of said schedule ahead of time. It turns out that schedule is pretty crowded, because all week long, there have been continued reports of recurring outages all across the Comcast network. Comcast, of course, continues to be pretty much silent on the issue, leaving its increasingly fed up call center staff to deal with incredibly angry customers who feel they're getting no information at all. How hard is it to admit that they screwed up and they're working on fixing the problem? Instead of chalking it up to bogus scheduled maintenance or pretending there's nothing wrong, admit what the problem is and give people real updates. People would still be unhappy, but at least they'd feel like the company wasn't ignoring them. Of course, maybe they can't do that because Comcast staffers don't have any internet access either...

Elgato Systems on Monday introduced the EyeTV 500, a new digital video recording (DVR) system for North American Mac users that lets users record both digital standard definition television signals and ATSC-based high definition signals broadcast over the air in North America. Based on the EyeTV 400, the new 500 model uses FireWire and lets users record television programs straight to their hard disk drives, where the shows can later be watched or burned to VideoCD or DVD using Roxio's Toast Titanium software. AT&T Broadband / Comcast or "I'd Rather Eat Glass"

Damn.  Last week Kasia got screwed by AT&T / Comcast.  Now its me.  Here's what happened:

  1. Come back from meeting with a client about a bunch of rather interesting stuff.  Some Inbox Buddy, some Feedster for internal use, some Frontier consulting and some miscellaneous other open source issues. 
  2. Virtually no network performance at all.> 200 ms ping times, hosts not resolving, etc.  Call AT&T. 
  3. Suffer thru one of the worst voice response systems I've seen in a long time.  Horrid.
  4. Reach a technician.  He makes me remove my PC from the Linksys broadband router that shields my PC from the outside world.  I'm not happy about this but a 10 Base T coupler makes it a lot easier.
  5. He tells me to restart.  I counter with "ipconfig /renew".  He shuts up.
  6. I start doing some ping tests and he's telling me that all is well and happy, frothy goodness since he can ping me fine. 
  7. I start to traceroute and give him feedback about the broken routes.  I ask him:  What's an email address so I can mail it to you?  "I don't have one".  What's a hot mail account I can send it to?  "I can't give that to you either."  So I ended up reading him the bad routes.  Pathetic.  And this from a company that sucks $50 from me monthly for broadband?
  8. I finally give him the info, he checks it from there after a 5 minute hold session and B I N G O !  I was *right*.  They have a problem on their internal network and then I had to wait on hold for another 5 minutes while he filled out a trouble ticket.  Then I got the really bad news.
  9. "It'll be resolved within 72 hours.  Not necessarily fixed but hopefully a solution decided upon."  What the fsck does that mean ?  That within 3 days from now, you'll decide how to fix it and then take as long as you like?  Utterly, totally pathetic. 

End result?  Over an hour of my time shot to hell simply because AT&T can't proactively monitor its own damn network.  I tell you, times like this?  I'd rather eat glass than be an AT&T customer.
