The U.S. House of Representatives has buckled under pressure from technology companies and wants to intervene with accounting standards bodies to let companies keep misleading their investors. That's the bottom line in Tues day's U.S. House of Representatives vote (Mercury News) to allow companies to continue to hide the cost of stock options from the bottom line. It's a shame to see this, but not surprising. The House did say that it would require companies to expense options granted to the five top executives in many companies. Apparently, financial transparency is sort of, kind of, sometimes useful, after all. A better idea would have been to eliminate options entirely for those senior folks. They have the most incentive -- and the most ability -- to tweak financial results to get short-term advantage that gives them giant paydays when stock prices rise. Keep options for the rank-and-file, but account honestly for them. The whole thing is probably a charade, anyway, because the Senate seems unlikely to go along with the House on this. Eventually, stock options are going to be expensed. Eventually, Silicon Valley will face reality.

Taiwan's Luxpro, unveiled an iPod shuffle clone last week at the CeBIT trade show in Germany last week. On Thursday Apple lawyers worked to have the Super Shuffle removed from the show, and though the device was gone from the Luxpro booth on Friday, it reappeared on Saturday. "Our lawyers are in the process of weighing legal options," Apple press spokesman Georg Albrecht said. Luxpro's Super shuffle is nearly identical to Apple's iPod shuffle measuring in at nearly the same size but also offering a voice recorder and FM tuner. The company even had iPod silhouette-style advertising to promote the device around the show.

While VCs are back to funding startups, without a really hot IPO market, it seems that many startups are having difficulty attracting top-notch executives. At least that's what the article suggests. Apparently, execs don't necessarily want to jump on the next hot thing, without some form of stability (read: more cash) or a higher likelihood of an IPO (read: potential for a lot more cash). Of course, it sounds like some of the requirements companies are putting out are a bit stringent. I agree that experienced execs are very useful to startups, but too often it seems that startups look for the perfect exec who has done exactly the same thing in the past. Those candidates aren't always the best. They may have gotten lucky in a previous startup and now feel they know everything, while a smarter, hungrier less "experienced" exec may be able to do more to drive a startup forward. Either way, if the IPO market takes off again, it's likely these missing startup execs will return -- and that might not be a good thing. A startup exec who jumps ship just because of the opportunity for a big cash payout isn't always going to be the best person to help build a sustainable company. You want someone who believes in the long-term potential of the company and its vision -- not the short-term potential of an IPO.
