A well-known company, running a massive multi-player virtual world,
was considering adding a new space to their world. Due to the nature
of the space, characters there would probably want to make music. So
the programmers created a set of virtual musical instruments, and
tools for players to create their own instruments. The plan was that
players would get virtual instruments and make music, for all of the
reasons people make music in the real world.
But management nixed the idea, on advice from lawyers, because of
concerns about copyright infringement. The problem was that players
might use their virtual instruments to play copyrighted songs, and the
game company might be sued for contributory or vicarious copyright
infringement, for failing to prevent this.
A pen (and a flute) is truly mightier (and scarier) than a sword...
I have an idea (for free use, just remember to pay me): Why don't we
just license musicians the same way we license driving? I mean,
obviously the music arts are very dangerous, as one could
inadvertently play music that someone else has already invented, so we
should slap obligatory training and yearly license fee for anyone who
practices or performs music. This money could be used to pay starving
artists (the mythical creatures that inhabit the caves in Kansas). In
addition, we could also license listening to the music: make everyone
pay every time they hear a tune that has been copyrighted. (No wait,
I think that's already being done.)
For the humour impaired, the above paragraph is sarcasm.
S-A-R-C-A-S-M. Or irony. I always get them mixed up. But I reserve
the right to have been right if someone seriously suggests in the
future that music performances in private establishments (like homes
or offices) should be stopped because someone might play copyrighted
songs.
Is copyright still enabling innovation and creativity? Maybe a
hundred years ago - but today... I don't know. It certainly doesn't
look like it anymore.

Being the green gal that I am, but not wishing to
sacrifice my own health for the planet (sorry, earth, just being
honest), I decided just to re-use the flimsy plastic water bottles for
as long as I could. I was happy with this solution for quite some
time, until I learned the horrible truth: HARMFUL BACTERIA! Yes, with each refreshing sip I was
backwashing germs into my water and providing them with a warm, wet
place to grow.
So I did what any bacteria-fearing primate would do and bought a nice,
reusable Nalgene bottle. Boy oh boy, nothing makes you look or feel
more like a tree-hugging, mushroom hunting nature girl than one of
those bright, hard plastic bottles! Until it comes out that Nalgene
gives you BRAIN
DAMAGE! Yes, Bisphenol A, used to make Nalgene bottles and other
hard plastic projects, apparently seeps into the body and can, in
certain doses, mess with the function of the brain. (I’m
paraphrasing/exaggerating and not everybody
agrees, so look it up.) I could almost dismiss the fear as
environmentalist fear mongering, but it turns out that California
legislators take the threat seriously enough to consider banning it in children’s products.

12/17/2003 01:12 PMYears ago, I was driving down a winding, snow covered hill, and as the
road turned left and I turned the steering wheel left, the car kept
going straight - right into a lamppost. I'll admit, it wasn't the
most fun experience of my life - though, amazingly, I did no damage to
myself or the car's engine. The car's body was a different story. But
despite the front of the car wrapping itself around the lamppost, I
eventually drove the now oddly shaped car home. I wasn't going
particularly fast when the accident occurred (it was a winding, snow
covered hill, after all), so I can only imagine what happens to cars
(and drivers) who hit lampposts at much higher speeds. Over in the
UK, they're trying to do something about that by
putting up
more flexible lampposts that will "bend" under a car when hit.
They actually have two different kinds of bendable lampposts. In the
city, the lamppost is designed to buckle - so that it moves, but
doesn't fall. In more rural settings (where it's less likely
pedestrians are around) the posts are designed to fall. Already, the
posts have been involved in a few accidents - including one of a car
driving at 90 miles per hour - and none have resulted in driver
deaths. One other benefit is that the material used to make these
posts is apparently recyclable, which I guess will be helpful when
trying to decide what to do with the crumpled post after an accident.

Jason Cross over at ExtremeTech reviews their latest desktop
replacement laptop, the Area-51m 7700, and it's pretty
impressive—as it should be, since it forgoes most laptop parts
and actually uses desktop chips crammed inside its not-so-portable
12-pound chassis. What you get in the end is a laptop that should
rarely leave your desk, but provides most of the functionality of a
full-size PC. Look, it even comes with all the fans of a regular-sized
PC.

Nice. At first glance the phone, with its wedge-shaped design, reminds
us of the N-Gage, but the 7700 is designed for a lot more than playing
games. The 7700 has a large, 640x320 resolution, 65,000 color
touchscreen which can be used for watching video and surfing the web,
built-in Bluetooth, a VGA-quality digital camera, 64MB of RAM, and an
integrated FM tuner. Nokia will also offer an attachment called the
Nokia Streamer which will let the 7700 receive special digital TV
broadcasts. Expect to hear a lot about this in the coming days and

The Nokia 7700, the Series
90 prototype phone with the touchscreen and looks of a stormtrooper
dropping has been dropped from Nokia's lineup according to the
company. Although Nokia's EVP Matti Alahuhta maintains that more
Series 90 phones will be released in the near future (especially next
year), the 7700 was likely too out there for Nokia to put their full
weight behind -- remember, this was one of the last phones bearing the
vestiges of Sidetalkin'. I'm disappointed, though; for all it's
probably failure in the market, the 7700 was clearly something unique,
and I would have liked to have played around with it, at least.
Pre-production 7700s will still be used to showcase Series 90
features, though, so don't be too surprised to see the units still
popping up here and there.

cellphone was that it looked a lot like the N-Gage. We didn't realize
how right we were. Our pal Rich Brome of PhoneScoop got confirmation

going to be at Moffett Field this week (13th-18th). That's right next
door to work. Like last year, which I missed, there will be ground
tours for $8 and if you pony up $400, you get a 30 minute flight. (I
think they were $300 last year?) I'm very, very tempted. Besides, I
believe the $400 is tax deduction. Anyone else planning to go--either
to walk through or...

05/26/2004 05:57 AMI am a very proud and loyal American. I support the principles of
this country and would never do something that would put me under
Uncle Sam's scrutiny. As a citizen I pay taxes to Uncle Sam so that
my children and I sleep well at night knowing that the government is
watching our backs and doing the things that keep us on top of the
technology power curve. So I am not all sympathetic
when I hear about some knuckle head messing around with government
sensors out in the desert.
Everyone has seen the movies and heard the rumors about Area 51 and
I am sure their are a lot of people that would give their eye teeth to
visit the site. Uncle Sam has the area restricted for a reason and
that is good enough for me. When someone is out there digging up
sensors in my opinion that is bordering on treason. So I have no
qualms when someone messes with federal property
I would expect the FBI to find out if the individual is a curious
george or a foreign spy.
We all are entitled to our opinions and are responsible for our
actions. You are free to do a lot of things but people need to realize

moment.
So continuing the thought from Saturday, I think I've gotten some
great reception to the idea of having an "un-conference"/get together
about mobility. Since I'm up in Emeryville and not technically in
Silicon Valley, I decided to call it the Bay Area Mobility Forum. I
just registered mobilityforum.org as well.
Now, what's the best way to organize online? There's three ways I
can think of - I can:
1) Start a Yahoo Group. But I think that's aging platform. Yes,
once upon a time it was cool, but now mailing lists are so
passé.
2) Start a wiki. I could grab JSP Wiki and have it up and running
in a matter of minutes. And I think Wikis are wonderful and cool and
all that, but I may be too type-A to deal with the hassle of a zillion
people editing pages without control.
3) Start a blog. I think this is probably the best option. And I'm
not even thinking about using *my* weblog, but the new Blogger. It
supports multiple authors, comments, etc. It doesn't supprt RSS which
sorta sucks, but the rest is pretty great.
I'm partial to the blog because it's easier to diseminate timely
information, comments are great ways of getting feedback without
getting things lost in discussion groups, and by inviting multiple
authors, I can - like Mobitopia - take the load off me when I flake
out and move on to other shiny things that catch my interest.
In terms of the what the goal is of the get together, I think it's
a great idea to copy wholesale from the OWC.
Thus:
The Bay Area Mobility Forum mission is to cultivate and
accelerate Silicon Valley's mobile and telecom sectors through
leadership, technology, government relations, research, education,
mentoring, investment, recruitment, networking and promotion.
And free beer. Let's not forget the free beer. And
pizza too.
So in the coming days, I'll throw up a blog, invite people who are
interested in helping me organize this thing to become editors, we'll
figure out a good date for the inaugural meeting (we can use my
current offices at WaveMarket - where there's a conference room for
about 50 people and a couple board rooms for sessions), guage interest
among potential attendees, figure out some topics to chat about and
maybe get a few mobile-sector leaders to give a presentation, send
some emails to everyone I can think of getting them to show up with
their gadgets and other mobile toys...
Actually, most people will show up for the beer. I just want to see
the gadgets. No one gets in the door without a cool toy. (Just
kidding).
