Some NorVergence Victims Get Out Of Scam
Leases
12/27/2004 04:42 AMBack in September we wrote about
the
NorVergence scam. Basically, the company was selling some telco
equipment that was available on eBay for about $300, renaming it "the
Matrix," sending fast talking sales people in to small, non-tech savvy
businesses, and promising that the box could provide "unlimited
broadband, landline and cell phone service with no per-minute
charges." The details, of course, proved this wasn't quite true.
Also, instead of just selling the boxes, they would lease them for
upwards of $300/month for
five year leases. Then, to make the
scam even better, they sold off those leases to a variety of financial
institutions, cashing out right away. The company then proceeded to
shut down, making the boxes completely useless -- but the banks who
had bought the leases didn't care at all and still expected their
money. Thus, they started sending threatening legal letters to those
people who weren't paying -- even though none of the "buyers" were
actually receiving service. NY Attorney General Eliot Spitzer has now
convinced the banks to forgive the leases for NY
companies that had been scammed, though there are still plenty of
others. Of course, the real issue is that both the financial
institutions and the end-customers were scammed -- and the NorVergence
executives went off to start another company accused of bilking
investors out of millions before shutting down.

No, Free Wi-Fi Doesn't Cause Bankruptcy
08/04/2004 01:09 PMSchlotzsky's files for Chapter 11 protection, but it's not the Wi-Fi
that did it: Before the wags weigh in, there's no connection between
Schlotzsky's aggressive and cool free Wi-Fi rollout and their Chapter
11 bankruptcy reorganization filing yesterday. The Motley Fool notes
that the CEO (a smart guy that I met when he served on a panel I
moderated last year) and an SVP were removed from their positions but
remain on the board. The chain has lost a more than 200 stores out of
760 in 1999. But don't blame it on the Wi-Fi....

Excilan in Bankruptcy
04/16/2005 02:35 PM Hotspot payment system provider enters bankruptcy, halts services: I
obtained information yesterday that Excilan, a
Luxembourg-headquartered firm that offered a unique method of payment
for hotspot services, has entered bankruptcy in that country Friday.
The service will halt operations Monday at noon local time according
to details I received. Excilan allowed cell phone users at a Wi-Fi
hotspot to enter their number on a gateway page and receive a
confirmation call that they could use to agree to pay for the service.
Customers of cell operators that hadn't agreed to work with Excilan
were granted short, free sessions which Excilan used as a
market-research tool to find partners. I don't know the details of why
the company has gone into bankruptcy; they were privately held. The
company has been remarkably upfront about its usage, however, posting
statistics on its home page. The most recent quarter saw 7,098
sessions, which at the highest possible commission and split might
have meant just a few U.S.$10,000s. Sean O'Mahoney joined the firm
last year as CEO. O'Mahoney was formerly a founder and the CEO of
Vancouver, B.C., Canada's FatPort, which was an early Excilan partner.
I was unable to reach O'Mahoney for comment since obtaining the
news....

This Spammer
04/13/2005 07:23 PMLast month, in talking about spammer Scott Richter filing for
bankruptcy, we noted that people shouldn't get too excited, because it
was clear that the filing
had
little to do with monetary issues and was mostly an effort to hide
out from the various lawsuits against him. Now more information is
coming out, including the fact that the "bankrupt" Richter
made $1.2 million last year -- which might make you wonder
how he can legitimately file for bankruptcy.

Magis Files for Bankruptcy
Magis Files for Bankruptcy
01/07/2004 02:35 PMMagis Networks, a developer of chipsets designed to allow users to
network home electronics, filed for bankruptcy protection in
mid-December: In 2002, the company raised $48 million from big shots
including Motorola, Time Warner, Panasonic, and Sanyo. One analyst
cited here says the demand for networking home electronics didn't
materialize. He can't imagine why he'd want to hook his PC to
anything. I can! I think a lot of people would like to stream music
from their PC to their stereo. Still, there may be something to the
fact that perhaps the market isn't ready yet. One reason may be that
the higher speed wireless networks haven't made major headway into the
home yet and higher speed is required to steam video, for example,
from the Internet to a TV. I imagine the general public also sees
connecting multiple home electronics as a pretty complicated
undertaking. Until it's faster and simpler, this market space might be
slow to take off....
