Not sure what the deal is today with companies who have been using bizarre interpretations of intellectual property to their advantage suddenly getting hit with intellectual property lawsuits. First, we had the RIAA get sued for patent infringement and now MLB Online is getting sued for patent infringement over some patents concerning the real-time display of game information online. Not surprisingly, it's a small patent hoarding company rather than a company that is actually doing any innovating. Of course, MLB.com doesn't exactly have a sparkling record when it comes to intellectual property freedom. You may recall that they wanted to stop all other sites from reporting in-game data (facts) because they seemed to believe they owned all the rights to in-game data. Of course, you can't copyright facts. Once again, though, this lawsuit is unlikely to make MLB.com realize some of the problems with the way intellectual property is dealt with these days.

TiVo wins Pause Technology patent suit.

TiVo wins Pause Technology patent suit

Good news for TiVo today as they won a patent suit against Pause Technology. Pause Technology has a patent on the functionality of pausing TV, buffering live TV, and catching up to live by fast-forwarding. It sounds pretty close to what TiVo does, but a judge sided against Pause. It'll be interesting to see how well TiVo does in its own patent suits against other DVR manufacturers. [thanks Scott!]

  • So it looks like there really was something to Overture's complaint (Overture was purchased by Yahoo) that Google was infringing. The size of this settlement tells you that Google was very afraid. The quick calculations that everyone has done about the value of the settlement also tell you something about companies' claims that they can't properly value stock options on financial statements. It's only when you can hide the money from investors that it's an issue, apparently.

    In early 2001, someone at NCR, going through a bunch of random old patents they had, found one for a "portable personal terminal." While the product it described was unlike a PDA, they decided that the patent granted them the intellectual property rights to all PDAs. So, they immediately sued Palm and Handspring, the two major players at the time. In 2002, the court tossed the case out, saying it had no merit. NCR appealed the case, and had it slapped down again in 2003. Apparently NCR didn't get the hint and couldn't accept "no" for an answer. So they appealed again. Once again, the court has said no dice. PalmOne, which is what became of both Palm and Handspring after their merger says they hope that NCR has actually gotten the message this time and will leave them alone.
