Lindows.com and Microsoft Corp. today jointly announced that a worldwide settlement has been reached in the trademark infringement cases between the two companies. "This case was centered on the fundamentals of international trademark law and our necessary efforts to protect the Windows® trademark against infringement," said Tom Burt, corporate vice president and deputy general counsel for Microsoft. "This settlement addresses those concerns, and we are pleased that Lindows will now compete in the marketplace with a name distinctly its own."

Microsoft's trademark lawsuit against Lindows will continue to trial, possibly later this year, after a federal appeals court denied Microsoft's appeal request. Microsoft was questioning an earlier court decision that found Microsoft's trademark on "Windows" to be potentially invalid because the word is a common term. Microsoft had argued that the term wasn't generic in the computer industry, despite its general use to describe onscreen objects in various graphical systems dating back almost 30 years. And because Microsoft does own a trademark on the term, it had sued Lindows for naming its Linux distribution Lindows, a name that might confuse consumers.

Fortune's David Kirkpatrick is looking at the Microsoft suit against Lindows.com accusing them of trademark violation. He talks to Lindows CEO Michael Robertson, and buys into his arguments completely... until he speaks to a Microsoft representative. The arguments seem to be all over the place, but the one point that is most important is whether or not people will be confused by a product called Lindows, and think it was created by Microsoft. Microsoft claims to have a study saying that 18% of people would be confused. Is that enough to force a name change? Meanwhile, Kirkpatrick points out that the folks at Microsoft should probably be more worried about the actual desktop Linux offerings that are coming along, rather than what anyone calls their products.

This isn't a huge surprise, but the Geico lawsuit against Google and Overture for showing competitors' ads on searches including the term "Geico" is been given the green light to move forward, and wasn't simply tossed out. Apparently, the judge believed Geico that this somehow was trademark infringement. Hopefully, Google and Overture can get a good legal strategy together in time for the actual case. It's been said many times before, but this is not trademark infringement, it's advertising. The point of trademark is to protect your brand against being hijacked by someone else pretending to be you. It's to avoid consumer confusion. It's not, like a patent, designed to keep everyone completely away. As long as the ads in question don't try to trick users into believing that they are Geico, there's no trademark infringement. It's no different than trying to get yourself on the same super market shelf as a more popular brand. You want to be in the same place when someone is looking for your competitor. If anything, Geico should be focusing on specific ads that confuse users into believing that the ads are for Geico instead of a competitor. Speaking of which, Google and Overture should have nothing to do with this case. They're not the ones who created the ads, but are simply the vehicle for delivering them. If Geico has a problem with the ads, they should be suing the advertiser in question. The fact that the judge didn't get these things early on suggests that Google and Overture's legal strategy has not worked properly so far. Considering the potential impact of a loss in this case, they may want to re-evaluate their legal strategy.
