Copyright Progress, Maybe
The U.S. Copyright Office wants
comments on
"the issues raised by 'orphan works,'
i.e., copyrighted works whose owners are difficult or even impossible
to locate. Concerns have been raised that the uncertainty surrounding
ownership of such works might needlessly discourage subsequent
creators and users from incorporating such works in new creative
efforts or making such works available to the
public."
This is wonderful news, and a sign of that
people like Larry Lessig are
making progress in educating the powers-that-be on the issues.
Public Knowledge has a
good summary.
This is good news. Of course my opinion is
that orphan works should go to the public domain. I guess the details
of how one determines whether something is an orphan or not will be
important, but I'm sure we can think of something. Lessig's idea of a
minimal charge to keep your copyright alive comes to mind.

Politicians Don't Mind Copyright
Infringement When It Works For Them
02/12/2004 12:35 PMWhile House and Senate elected officials have made big deals out of
the importance of intellectual property, it hasn't been on the radar
screen of the Bush/Cheney administration... or has it? NBC got angry
that the campaign released an online commercial for the President
using
footage from an interview done on NBC. The campaign insists
they've done nothing wrong. Does that mean they're supporters of
"fair use"? Chances are they've never actually thought about the
issue, and this is yet another case of politicians who would push for
more stringent intellectual property laws, while making sure to ignore
them themselves when convenient.

21-year-old essay on copyright just as
fresh today
05/04/2004 05:14 AMLuís sez: "Barrington Bayley has a *very* interesting article
written in the early 1980s about the ethics and the convention of
copyright. It's also worth pointing out that Bayley is one of the
great unheralded geniuses in the field of literary science fiction."
On the premise that graphic reproduction will eventually go the way
of sound reproduction, i.e. it will become easy and cheap and
available to all, the same is due to happen to literary copyright.
It's a-coming, boys! You'd better get used to it!
...Yes, there is always going to be a living for writers. The
consequence of the above is that a book, whether incarnated in ink and
paper, laser disk, silicon, gallium arsenide, memory bubbles, or War
and Peace encoded in DNA, will cost more than the blank on which it is
inscribed, but not so much more that it would be worth your while to
borrow a copy and duplicate it. Whatever deal authors and publishers
make with one another will have to take cognisance of that. I expect
authors will still be able to demand royalties. Whether an author will
be able to become stinking rich, as a few now can, I don't know. What
does it matter? It isn't necessary to the continuance of civilisation.
Luís adds, "This over twenty years ago."

P2P Wins Court Battle in France
P2P Wins Court Battle in France
03/14/2005 04:34 PMI take back some of things I had thought about our friends across the
Atlantic. A French Appeal Court ruled that a countryman who downloaded
500 movies via P2P was within his rights because he used them for
private viewing, not distributing or selling them to the public. He
also paid tax on the blank media he recorded it on. No harm, no foul
said the courts. Now that is a ruling that makes sense, common sense.
