won a $4 million judgment against a spammer. The interesting
part, though, is that the legal issue wasn't the spamming, but
"trademark infringement, false advertising and cybersquatting." The
spam in question apparently advertised a toolbar that claimed to keep
Microsoft Windows updated. The article doesn't say what kind of
spyware the product actually was (but, you have to assume it was
spyware). Though, it may be difficult to collect, Microsoft claims
that it's already taken in approximately $54 million from the various
spam cases it's been winning. While that's pocket change for
Microsoft, that's still a pretty good chunk of change. Maybe there's
a business model in really suing spammers after all.

Richter, the founder of spamming service OptInRealBig, are currently
in the middle of a fairly nasty
legal
battle over whether or not SpamCop can block OptIn's spam. Still,
the two have
agreed to appear together in public and debate the topic.
Both of their lawyers say that the debate will avoid the issue of the
lawsuit, but as the article points out, that seems unlikely. The
thing is, in listening to what both sides have said over the years,
you already know what they're going to say in this debate - and
they're talking at cross purposes. The spammers focus on their right
to make money, while everyone else talks about their right to be left
alone. The problem with the spammers' position is that they
don't have the right to make money. They have the right to
try to make money, but if it involves pissing everyone off, and
everyone decides to create and use filters to make email bearable
again - then that's their right too.

body slammed. In a court ruling in Paris a spammer has to pay a fine
of around 13,000 Euro's along with their legal fees (ouch). He has to
advertise the court ruling on his own website and pay for advertising
on the ruling against him. I can not even imagine how much this ruling
is going to cost by the time it's all over but I bet he will never

New to the official release of MSN Spaces is advertising, with Volvo
as the first customer -- putting its banner ads on Spaces and also
sponsoring a "best of" page, inviting people to write about
experiences with their automobiles. MSN Spaces staff will scour other
blogs for compatible posts and put them on the Volvo site, according
to Microsoft (MSFT: news, chart, profile) .
The company also released a new version of its MSN Messenger software
for instant, voice, and video messaging. It too will have advertising,
starting with Coca Cola Co.'s (KO: news, chart, profile) Sprite
offering downloads of "theme packs," which include animations and
backgrounds and audio clips. American Greetings Corp. (AM: news,
chart, profile) also plans to sell icons for personalizing messages.
"It's just a way for people to express themselves," MSN corporate vice
president Blake Irving told the Seattle Post-Intelligencer. "It's
advertising but it doesn't feel that way."
MSN has also added a search button into the Messenger window to boost
use of MSN Search.
