04/13/2005 04:36 AMFlorida prosecutors have been granted an injunction against two men
accused of running mass e-mailing operations, in what is the state's
first victory against spam. The move will prevent Scott Filary, 25,
and Donald Townsend, 34, both of Tampa, from sending deceptive
e-mails. It's the first to be granted under an anti-spam law passed in
the state last year.
The pair are accused of sending more than 65,000 e-mails, with
misleading subjects and disguised origins, and Charlie Crist, attorney
general, said links took recipients to sites engaged in fraud or
illegal activities like selling pharmaceutical drugs or cigarettes
online.
Anti-spam laws in Florida allow for a fine of up to $500 per e-mail
sent - making the two accused liable for a fine of up to $24
million.

won a $4 million judgment against a spammer. The interesting
part, though, is that the legal issue wasn't the spamming, but
"trademark infringement, false advertising and cybersquatting." The
spam in question apparently advertised a toolbar that claimed to keep
Microsoft Windows updated. The article doesn't say what kind of
spyware the product actually was (but, you have to assume it was
spyware). Though, it may be difficult to collect, Microsoft claims
that it's already taken in approximately $54 million from the various
spam cases it's been winning. While that's pocket change for
Microsoft, that's still a pretty good chunk of change. Maybe there's
a business model in really suing spammers after all.

05/11/2004 07:36 PMA couple weeks back we wrote about how Scott Richter, who runs the
well known spam operation OptInRealBig was
suing
SpamCop for damaging his reputation. Now, a court has
issued a
temporary restraining order against SpamCop saying they cannot
send complaints about OptInRealBig to other ISPs
and says they
cannot make anonymous complaints. The restraining order is only good
until May 20th, when SpamCop will respond in court - so it's not a
huge deal since it's for so short a time period. However, the
anonymity question is a bit one, since many people use SpamCop to
report spam assume they are reporting spam anonymously. Again, like
other cases, I wonder why SpamCop/IronPort could possibly be at fault.
They're only making it easier to report potential spam. The people
actually doing the reporting are the ones who are actually accusing
OptIn of anything - which is probably why OptIn wants them revealed as
well.

Richter, the founder of spamming service OptInRealBig, are currently
in the middle of a fairly nasty
legal
battle over whether or not SpamCop can block OptIn's spam. Still,
the two have
agreed to appear together in public and debate the topic.
Both of their lawyers say that the debate will avoid the issue of the
lawsuit, but as the article points out, that seems unlikely. The
thing is, in listening to what both sides have said over the years,
you already know what they're going to say in this debate - and
they're talking at cross purposes. The spammers focus on their right
to make money, while everyone else talks about their right to be left
alone. The problem with the spammers' position is that they
don't have the right to make money. They have the right to
try to make money, but if it involves pissing everyone off, and
everyone decides to create and use filters to make email bearable
again - then that's their right too.

more interested in the way(s) spammers collect their victim's
addresses. In fact, I routinely receive junk mail in various languages
I don't even understand (Chinese, German, Korean, Brazilian, and God
knows what else), let alone having any relationship whatsoever with
those countries. So I started thinking how the heck some email
addresses of mine ended up in those spamming lists.

un-secured hotspots and sending spam from the open connections: The
original story here is one of those infuriating reads that doesn't
mention how the guy got caught. It seems that historically people who
have gotten caught for improperly using hotspots have done so by being
stupid or unlucky. It's otherwise difficult to track someone down
especially if they move around a lot looking for insecure hotspots....

hacking: Being a crazy sports fan is one thing. Spoofing the
email address of area sportwriters and spamming everyone, apparently,
is not.
But yesterday, Carlson sat alone in a federal courtroom in
Philadelphia, the accused boo-bird who hijacked the e-mail addresses
of area sportswriters and sent out tens of thousands of anti-Phillies
cyber-rants in their names.
"Like a lot of people, he was not happy about the fact that the
Phillies were not winning," Assistant U.S. Attorney Michael L. Levy
said in his opening statement to the jury. "But Mr. Carlson... decided
to do something more. He launched an electronic attack against the
Philadelphia Phillies and Philadelphia Newspapers Inc."
They're charging him with identify theft under federal law. He
sent 100,000 emails, one of which resulted in 60,000 bounces to a
local sports columnist.

It’s an interesting read. One of the main characters is a
moron who shows his ignorance at every turn. There are many claims
that what they are doing is Search Engine Optimization (SEO). There
are legitimate SEO companies, and there are guys like these. If you
are hiring a SEO company, make sure you know what techniques they are
using or you might end up with a site marketed in the same manner as
the porn and prescription drug schemes they are discussing.

caught trying to buy AOL screen names from an employee.
...Dunaway was a "very nice gentleman. You'd never expect anything
like that," said neighbor Christo Zaferatos.
"That," of course, was the swarm of federal agents busting down
Dunaway's door early June 23 and hauling him off in handcuffs. Federal
prosecutors accused him of an audacious crime: conspiring with an
America Online employee to steal 92 million AOL e-mail addresses later
sold to a spammer hawking penis-enlargement pills.
Dunaway ran an online gambling venture, Justice Department
prosecutors say, making as much as $20,000 a day, enough to pay the
rogue AOL employee $100,000 for the highly sought addresses.

fined this
week for sending out a ton of SMS text spam to mobile phones. The
company apparently went through classified ads in newspapers to
collect phone numbers, which they then spammed. While the company in
question initially apologized for the spamming and said it was an
"honest mistake," it's beginning to sound like that apology wasn't so
sincere. The company is now hitting back that the anti-spam law
is unfair to smaller companies, because it takes
away this particular way to annoy people -- while larger companies can
still use telemarketers to annoy users in a different (but similar)
way. Of course, all this really suggests is that Australia needs to
do a better job stopping unwanted telemarketing also. The spammers
have clearly missed the point. It doesn't matter whether others are
allowed to do similarly annoying practices. It's that such
unsolicited interruptions are a real nuisance to people no matter who
they're from or what format they happen to arrive in.
