Spammer, Anti-Spammer Involved In
Lawsuit Will Hold Public Debate

Spammer, Anti-Spammer Involved In
Lawsuit Will Hold Public Debate
05/20/2004 11:41 PM
Julian Haight, the founder of anti-spam service SpamCop, and Scott Richter, the founder of spamming service OptInRealBig, are currently in the middle of a fairly nasty legal battle over whether or not SpamCop can block OptIn's spam. Still, the two have agreed to appear together in public and debate the topic. Both of their lawyers say that the debate will avoid the issue of the lawsuit, but as the article points out, that seems unlikely. The thing is, in listening to what both sides have said over the years, you already know what they're going to say in this debate - and they're talking at cross purposes. The spammers focus on their right to make money, while everyone else talks about their right to be left alone. The problem with the spammers' position is that they don't have the right to make money. They have the right to try to make money, but if it involves pissing everyone off, and everyone decides to create and use filters to make email bearable again - then that's their right too.

I love these stories when Spammers get taken to court and then get body slammed. In a court ruling in Paris a spammer has to pay a fine of around 13,000 Euro's along with their legal fees (ouch). He has to advertise the court ruling on his own website and pay for advertising on the ruling against him. I can not even imagine how much this ruling is going to cost by the time it's all over but I bet he will never spam again. [ZDNet]

Microsoft Wins $4 Million From Spammer 07/15/2004 08:36 PM
Microsoft has apparently won a $4 million judgment against a spammer. The interesting part, though, is that the legal issue wasn't the spamming, but "trademark infringement, false advertising and cybersquatting." The spam in question apparently advertised a toolbar that claimed to keep Microsoft Windows updated. The article doesn't say what kind of spyware the product actually was (but, you have to assume it was spyware). Though, it may be difficult to collect, Microsoft claims that it's already taken in approximately $54 million from the various spam cases it's been winning. While that's pocket change for Microsoft, that's still a pretty good chunk of change. Maybe there's a business model in really suing spammers after all.

Microsoft's problems convincing customers that Software Assurance maintenance program is a good deal continue, according to a number of recently-surveyed Microsoft customers. Microsoft has been aggressively pushing Software Assurance, a contractual upgrade rights program that allows businesses free upgrades -- and other benefits -- in exchange for annual fees over a two- or three-year timeline. But there appears to be some disconnect between how Microsoft wants to sell its software and how businesses want to buy, an analyst said on Monday.

Wi-Fi Spammer Gets Busted

Wi-Fi Spammer Gets Busted 09/07/2004 12:32 PM
A spammer in California has been accused of driving around looking for un-secured hotspots and sending spam from the open connections: The original story here is one of those infuriating reads that doesn't mention how the guy got caught. It seems that historically people who have gotten caught for improperly using hotspots have done so by being stupid or unlucky. It's otherwise difficult to track someone down especially if they move around a lot looking for insecure hotspots....

Spammer discussion

Spammer discussion 01/12/2004 01:53 AM

Blog and guestbook spammers are discussing spam techniques in this Usenet thread found by Andy Baio.

It’s an interesting read. One of the main characters is a moron who shows his ignorance at every turn. There are many claims that what they are doing is Search Engine Optimization (SEO). There are legitimate SEO companies, and there are guys like these. If you are hiring a SEO company, make sure you know what techniques they are using or you might end up with a site marketed in the same manner as the porn and prescription drug schemes they are discussing.

They also linked to my AP News article on spam. So they know we’re watching.

Spammers strike back? Well then call this return of the Webmaster Jedi. As a blogger and domain owner, I am sick of waking up to fifty new comments, all of which are spam for something of dubious legality. The fine folks at Kalsey are angry too. And they declared war. Lots of people stood up and took notice. What can you do to help stop this infestation? Blacklists and Bayesian filtering come to mind... (Via Smart Mobs)

Why you might be an unwitting spammer 05/27/2004 03:22 PM
Continuing in my quest for a spam-free mailbox, I have become more and more interested in the way(s) spammers collect their victim's addresses. In fact, I routinely receive junk mail in various languages I don't even understand (Chinese, German, Korean, Brazilian, and God knows what else), let alone having any relationship whatsoever with those countries. So I started thinking how the heck some email addresses of mine ended up in those spamming lists.
