rry Ellison testify in the important antitrust case in
which the government is trying to block Oracle's buyout of PeopleSoft.
Ellison was, as you'd expect, a cool customer of a witness. But his
appearance may have been something of an anticlimax, given that the
issues of this case have been pretty well thrashed out by previous
witnesses.
Still, it was fascinating to watch. More later.

compensation arguments. Everyone likes to argue over who's overpaid
and who's underpaid. Luckily, we no longer need to argue over it
(yes, I know you will anyway) because the San Francisco Business Times
has put their crack research team to the task, where they discovered:
celebrity CEOs Terry Semel and Larry Ellison were
underpaid, while Steve Jobs was overpaid. The article doesn't
mention it, but Steve Jobs salary was only $1 last year, which may
make you wonder why he's considered "overpaid". It turns out that
Apple
granted him nearly $76
million in stock, which sort of offsets the low basic salary (not
to mention his $52 salary from Pixar and his free use of the corporate
jet). Ellison, on the other hand, earned just $59,165 in salary.
Lucky for him, the $40.5 million he took home from cashing in stock
options didn't count in this game, since it wasn't part of his 2003
compensation from the company, but a personal decision to sell
holdings. Meanwhile, the worst on the list was Michael Cannon, CEO of
Solectron, who brought home $18 million while his company lost $3.5
million. Isn't that the point at which the CFO or the board should
have gone up to him and said: "Um... you think you could do without a
few million so the company is actually profitable under your watch?"

conservative essay on municipal telecom/broadband:
Benchmark is an investor in Tropos, disclosed in Gurley's essay, but
his essay is one that should make those that favor self-determination
in government and true competition cheer. He peels back in six points
the problems with the rash of laws sparked by a March 2004 Supreme
Court ruling to restrict municipal involvement in telecommunications
infrastructure and service.
In brief, these laws: favor incumbents by eliminating competition,
enforce the idea that oligopolies are competition, restricts American
innovation, restricts leverage for municipalities over incumbent
development, eliminates community service aspects of broadband, and
removes self-determination. I call this classically conservative
because he's in favor of competition, although many conservatives
would exclude municipalities from being involved as competitors.
"In what is ostensibly the cornerstone "democracy" on the planet, one
would think that the citizens in each of America's cities could simply
"vote" on the services they believe make sense for their city to
provide."

space: Ellison runs through the issues facing Tropos, a
Wi-Fi metropolitan mesh provider, and DynamicCity, which offers fiber
to the premises (FTTP). "The anti-muni bills present a scenario where

agreed with (they happen so rarely) where a judge had
tosse
d out author Harlan Ellison's lawsuit against AOL, saying that
AOL, as a service provider, was not responsible for Usenet postings
that contained Ellison's stories. Note, these stories weren't even on
AOL - but on Usenet, available from just about every ISP out there.
Ellison, though, has decided that it's not worth understanding the
technology when you can just sue and because he could see the posts on
AOL, it must be AOL's fault. Thus, he has
contin
ued fighting the case, to the point where he's spent almost all of
his money on the lawsuit. He insists that this is all AOL's fault
because it took them two weeks to respond to his request to block the
Usenet posts in question. Unfortunately, it appears that my relief at
a smart judicial ruling was premature. An appeals court has
overturned the ruling and sent it back to the court,
saying that AOL loses their DMCA liability protection because of the
amount of time it took them to respond. In other words, DMCA
protection against liability (one of the very few good things in the
law) is limited by your response times to complaints. Ellison,
continuing to miss the point, is declaring victory, but AOL is still
confident they'll win the case anyway.
