Attorneys for Microsoft Corp. head back to federal court on Tuesday to defend a landmark antitrust settlement from a last-ditch challenge from Massachusetts' attorney general and other critics. The two sides will square off before a panel of judges in the U.S. Court of Appeals for the D.C. Circuit, with critics of the settlement arguing it should be overturned and stricter sanctions imposed on the world's largest software maker.

We've written plenty of times in the past about how various spam blacklists are causing all sorts of problems by putting sites on their list (including Techdirt) that obvious ly haven't been spamming. However, as bad as being blacklisted is (and we keep getting blacklisted by Outblaze for no clear reason) should someone be able to sue for it? As far as I'm concerned, it's the problem of whoever decided to set up such an obviously bad spam filter and then rely on it to completely block, without review, all messages that were checked off as spam. However, others take it a step further and have decided to sue blacklists that wrongfully (probably) list them. The latest such case is about to go to court, according to an article in Salon.com. Again, it sounds like the guy suing is overreacting by blaming the guy who set up the list -- no matter how bad the list was. The problem is with those who relied on such a questionable list, and not the list maintainer. As the article notes, however, it looks like ISPs and companies are finally starting to realize that not all spam blacklists were created equal, and not all are worth using.

In a case that could have serious implications for venture capitalists and other investors in companies, the lawsuits that Univers al Studios and EMI filed last year against Napster's investors (including their own rival label Bertelsmann) have been combined into one case that is set to get under way next week. The two labels accuse the investors of being responsible for copyright infringement by keeping Napster in business longer and for inspiring "copycat" sites like Kazaa and Morpheus. Beyond the basic problem that (again) they are blaming the tool and not the actual illegal action, this also opens up a whole can of worms concerning any investment. The investors simply invest in the company, and while they may have some influence over what the company does, to blame them for illegal actions performed by users of a product seems to go well beyond reason. That's like saying we should blame investors in Ford if a Mustang is used to run someone down. It's going beyond blaming a tool that was misused and even beyond blaming the company or its management for creating a tool that could be misused, all the way towards blaming those who kept the company in business with their money. Clearly, without Ford's investors, the company would never be where it is today, and no one would be able to have Mustangs to run over others. Therefore, they must be guilty of manslaughter by association. In fact, why not take it one step further. Perhaps all of Ford's customers should be responsible (even if they only did legitimate actions with their vehicles) because they put money in Ford's bank account letting them stay in business as well. The argument is ridiculous and hopefully the judge will see it the same way.

A European ruling that the outfit must strip its media player from Windows chills chances of a settlement in the EU antitrust case

It's bad enough for Microsoft (MSFT ) that a European judge ruled on Dec. 22 that the software giant will have to disclose proprietary technical information to rivals and sell a version of Windows with its audio and video player stripped out. But the ruling's real damage is far more subtle. Microsoft had hoped that it would win a modest point, a setback for the European Commission that would bring it back to the negotiating table. But its victory was so sweeping that the EC has little impetus to resume talks. And that means Microsoft will continue to slog this case out in court.
