04/19/2004 08:13 AM Legal representatives of the SCO Group and IBM were supposed to meet
in Judge Brooke C. Wells' Salt Lake City federal courtroom Saturday,
April 17, to show new evidence supporting their cases in the $5
billion intellectual property lawsuit SCO Group filed against Big Blue
on March 6, 2003. The federal court isn't open for business on
Saturdays, so the date would have fallen to the next business day --
Monday, April 19. But nothing's going to happen today in Judge Wells'

Musicologist wins copyright battle over
300-year-old works
07/17/2004 11:19 AMBoingBoing reader
John says:
Dr. Sawkins, a musicologist, has won a copyright battle in
Britain over a 300 year old piece of music, "Music for the Sun King"
by Michel-Richard de Lalande. I understand that particular editions
of literature, for example, are often copyrighted: the layout, the
footnotes, etc, are all original. But the actual editorial choices-
what to include, how to conflate contradictory texts- I had assumed
were not copyrightable. By the logic of this argument, a good
editorial choice made in one edition of a piece of music can be seen
as infringing on the same choice made in another edition.

US Supreme Court to consider major
copyright and technology case
12/17/2004 06:30 PM
The United States Supreme Court agreed to
consider a high profile case involving the internet and copyright
infringement. The question, which has been subject to numerous lower
court rulings, concerns whether or not the creators of peer-to-peer
software can be held liable for users' copyright infrigement. The
companies cite the 1984 " Betamax case ," which immunized VCR makers from copyright
charges. The intellectual property holder side of the case charges
the software companies with knowing full well the uses to which their
applications have been put.
Metro-Goldwyn-Mayer Studios v. Grokster Ltd
involves a large group of players:
The large group of plaintiffs includes the Motion Picture Association
of America, the Recording Industry Association of America, Warner
Brothers Entertainment Inc. and a class of 27,000 music publishers and
songwriters. The Supreme Court will hear the case in March and is
expected to decide it by late June.

US Supreme Court to hear crucial digital
copyright case this week
03/29/2005 02:30 AM
The
Supreme Court of the United States is scheduled to hear arguments
this week in a high profile digital copyright case. In MGM Studios v. Grokster
a group of movie studios sued Grokster , a popular peer-to-peer
file-trading program, arguing that the software enabled enormous
infringements of the studios' intellectual property . Last year a federal circuit court ruled in favor
of Grokster; the case has proceeded on appeal.
Supporters of Grokster, such as
Electronic Frontier Foundation , argue that such
file-sharing tools should be considered in the light of the 1984 "Betamax case" ,
where the Supreme Court ruled that users, not devices, should be held
liable for copyright offenses. Other defenders, such as The Economist , believe that a
ruling against Grokster could stifle innovation . Allies of MGM argue that
file-sharing applications, unlike VCRs, are primarily about copyright
infringement. Moreover, they argue that the owners and maintainers of
such software are fully aware of that propensity for infringement.
The court's ruling could have enormous ramifications for the
internet.
