Reuters - A federal judge in San Francisco on Wednesday denied motions to dismiss lawsuits claiming past Napster investors like Bertelsmann AG (BERT.UL) and venture capital firm Hummer Winblad kept the song-swap site going, costing the music industry $17 billion in lost sales.

In a ruling that is bad news for investors everywhere, a judge has allowed the recording industry's lawsuit against the original Napster's investors continue. No matter what the legality of Napster was, this case represents a much bigger issue: are investors liable for what the company's they invest in do? Taken to its logical extreme, all the stockholders of companies like Enron and MCI should be responsible for the corporate misdeeds of those companies. Obviously, that's a bit ridiculous, but should major shareholders be responsible? If that's the case, life just got a lot harder for just about any VC, who has to be even more careful about what he or she invests in and some how has to personally guarantee the company won't break any laws.

This probably benefits consumers of the technology in that removing royalty costs will lower the bar to entry for manufacturers and reduce overall cost. The head of XtremeSpectrum is wrong when he said that it's clear that for a standard to be confirmed, it must not have any licensing strings attached--it must be royalty free unless he meant this specific standard. Plenty of standards are encumbered by reasonable and customary licensing fees, and the companies involved in 802.15.3a had already signed or generally agreed to that as well. The 802.15.3a standard will allow 100 to 480 Mbps of wireless data to be exchanged at very short range, from 10 to 30 meters, with the design focused on large file and streaming media exchange....
