The law firms of Hinkle, Hensley, Shanor, & Martin, L.L.P., Lerach, Coughlin, Stoia, & Robbins, L.L.P., and Freedman, Boyd, Daniels, & Hollander, L.L.P. counsel for a proposed class of New Mexico consumers, and Microsoft Corp. jointly announced today that a settlement has been reached in a class action lawsuit alleging that Microsoft Corp. violated New Mexico’s antitrust and unfair competition laws. The settlement, which received preliminary approval on July 29, 2004 from the First Judicial District Court for the State of New Mexico, will make vouchers available to class members that may be used to buy any manufacturer's desktop, laptop and tablet computers; any software available for sale to the general public and used with those computer products; and specified peripheral devices for use with computers. The total amount of vouchers issued will depend on the number of class members who claim vouchers, and the maximum value of the vouchers that may be issued to class members will be $31.5 million.

TOKYO — Japan plans to implant microchips under the skin of imported dogs in order to prevent rabies from making inroads into the country, government officials said Tuesday.

The plan intended for strict individual recognition of imported dogs was confirmed the same day at a meeting on the nation's quarantine system against rabies of the Ministry of Agriculture, Forestry and Fisheries and the Ministry of Health, Labor and Welfare, the officials said. (Kyodo News)

In a decision which will come as a massive relief to civil libertarians, the Supreme Court of the United States ruled today that United States citizens detained as enemy combatants have the right to challenge their classification in court, and sent the case of Hamdi v. Rumsfeld back to the district court with instructions to hear Hamdi's case and determine whether or not he was properly classified as an enemy combatant. As a necessary condition for that ruling, the Court also ruled that the administration could detain US citizens who were captured in a combat zone (and who were supporting an opposing army within that zone) until the conclusion of the conflict. (A related case, involving a US citizen apprehended at an airport and held as an enemy combatant, was dismissed on the procedural ground that the case had been brought in the wrong district court; the petitioner, Jose Pedilla, will probably file a new case in the correct court shortly).

As this NYT article makes clear, the case against imprisoned Army Capitan and Muslim Chaplain Yee gets thinner by the day, and provides abundant evidence for why nobody should have the unchallengeable power to imprison people on their word alone. Capitan Yee was held in solitary confinement and threatened with the death penalty, and we were told he was guilty of espionage and stealing classified documents. Then the government said he was guilty of adultery and pornography, now it turns out that the documents he had that made the customs inspector suspicious may not have been classified after all. This is the same government that claims the power to declare American citizen enemy combatants and imprison them for life. What do you think that Captain Yee's status would be today if he didn't have access to lawyers and judicial review of his case? I bet he'd be sitting alone in a dark cell, perhaps being beaten like some of the 911 detainees, and threatened with death unless he "confessed." Access to attorneys and meaningful judicial review for anyone imprisoned by the government is the only course that is consistent with the best of American values. Plus it's the law and the Constitution....

So as of this Friday the media's reporting that the House has passed and forwarded to the Senate a bill, called the "Marriage Protection Act", that would "prevent federal courts from ordering states to recognize same-sex unions that took place in other states". Except, wait a minute, isn't that exactly what the Defense of Marriage Act of 1996 did? So what's the point of this bill? Well, that's where things start to get interesting. If you go and look up this bill (H.R. 3313) on thomas.loc.gov, you'll find it actually amends the Defense of Marriage Act. And, in fact, all it does is add a single clause to the end of the DOMA, saying:`No court created by Act of Congress shall have any jurisdiction, and the Supreme Court shall have no appellate jurisdiction, to hear or decide any question pertaining to the interpretation of, or the validity under the Constitution of, section 1738C or this section.'.So, are you following this? This bill doesn't "prevent federal courts from ordering states to recognize same-sex unions that took place in other states", as Yahoo News puts it-- that's what the DOMA does. This bill does something much more interesting, and much more questionable: it bans the courts from ruling the DOMA unconstitutional.
