signed by many thousands of BBC staff asserting the fierce
independence of the BBC and talking about Greg Dyke's leadership as
Director General (see Guardian article). I don't have a lot to say about it
except to say that unfortunately my name and those of many other
people I know couldn't fit onto the page, but that shouldn't in any
way be read as a lack of support. It was signed and supported
financially by many more people than could fit onto that page - myself
included - and its impressive scale should be viewed as just a slice
of the even larger genuine ground-swell of sentiment throughout the
organisation.

primary reason cited was gross insubordination — an
unwillingness
on the part of the butler do as he was asked. Perhaps the fact
that the butler doesn’t help with of Jonas’s real needs
— the ones behind the statement I am busy still trying to sift
through all those advertisements — was also a factor. On the
surface, it seems that Google’s AutoLink meets the letter of
each
of Yoz’s three rules for determining if such a tool is within
the
spirit of the Web. However, upon closer examination, it turns
out
that there may be some wiggle room in the first rule. Today the
Google Toolbar for Internet Explorer is closed source. The
skills
and techniques for creating such a thing are well beyond the abilities
of most users. Heck, they are black magic to most seasoned
programmers. Simply put, if you can’t see the definition (and
furthermore don’t trust the author to the point of being willing
to write what amounts to a blank check), then how can a closed source
toolbar ever pass the “completely understood” test? What
if
such a tool were open source? Furthermore, suppose the tool were
well commented, and structured in such a way that people who have even
the most tenuous grasp on the concepts of HTML could reasonably modify
it to remove the links and content that they don’t want, and add
or reorder the links that they do want? Today Mark Pilgrim made
available a new butler that is all this and more. Made available
under the GPL. Share and enjoy. Now, Jonas, would you fire this
butler too?

04/26/2004 05:31 PMI don't normally publicize this fact, but a decent chunk of what I
earn goes to charity. For example, in addition to several smaller
donations, last year Bradbury Software donated $5000.00 to a local
women's shelter, and earlier in the year I gave $1000.00 to a local
children's hospitable.
The biggest problem for me isn't giving the money, but instead
figuring out which charities are worthwhile. All too often I've
donated to charities which sounded good but in fact did little to
actually help people other than themselves. Or I've given to
charities which were worthwhile, but circumstances beyond their
control prevented their help from reaching those who needed it.
Finding out which charities are worthwhile can take a lot of time,
so it's a blessing to discover a friend who has already done the work.
Every year my good friend Kevin Carter
hosts a "Waiting for Wishes" fundraiser dinner which raises money
for charities he's researched, and I'm always glad to be invited.
I have to confess, though, that part of the reason I enjoy the
dinner is because it lets loose the prankster in me. You see, Kevin
plays for the Tennesse Titans, and he invites fellow teammates to be
waiters. In order to raise money, those attending the dinner are
supposed to pay these NFL players to sign autographs, sing songs, etc.
Well, I figure I should get my money's worth, so I gave $1000.00 to
see Kevin play the part of Rhett Butler in Gone With the
Wind.
And of course Kevin had to choose another teammate to be his
Scarlett O'Hara.
Without a moment's hesitation, Kevin chose linebacker Keith
Bullock to play Scarlett. I'll tell you, watching these guys act
out the final scene of Gone With the Wind was perhaps the
most worthy cause I've given to :)

08/15/2004 11:15 PMLet's say I have a meeting on Monday nights during the time that
Fox's awesome guilty pleasure, "North Shore," is on. I
don't have a VCR anymore, so I can't tape it. And I don't have a Tivo either. What am I to do?
Well, I can download the show. There are any number of P2P clients
out there with which you can get a perfect, full-screen, letterboxed,
high-definition, stereo-sound copy of any TV show. An hour-long show
will download in anywhere from one to a few hours, depending on the
time of day. It's very practical to download a show you missed.
So, let's say I download and watch "North Shore." Have I broken
any laws? It's not like I stole anything — I'm a paying cable
TV subscriber and I have the cancelled checks to prove it. I could
have watched the show for free if I was home during the time it aired.
Additionally, if I had a VCR, I could have taped it and gotten the
same effect — watching the same show at a different time.
This is called "time shifting." There was a Supreme Court decision back in 1979 about the VCR in
which the Court ruled that taping a show and watching it later was
legal — the user was simply "shifting the time" in which he or
she watched the show. Here's a note from the Museum of Broadcast
Communication:
Handing down its decision in October 1979, the U.S.
District Court ruled in favor of Sony, stating that taping off air for
entertainment or time shifting constituted fair use; that copying an
entire program also qualified as fair use; that set manufacturers
could profit from the sale of VCRs; and that the plaintiffs did not
prove that any of the above practices constituted economic harm to the
motion picture industry.
(The term "time shifting," incidentally, is where The Shifted Librarian
draws its name.)
The only way I can see that someone got short-changed is that I
didn't watch any commercials (on most posted versions, they've been
edited out). So, this is a drag for the advertisers, but here's the
thing: I don't watch commercials anyway. I'm a quick-draw on the
remote when a commercial comes on. I channel surf until they're over.
Or I get up and go to the bathroom,or get something to drink, or
finally listen to what my little girl has been deperately trying to
tell me since the last commercial. Additionally, if I taped the show
with a VCR, I'd fast-forward through the commercials.
I think the content type matters. I very much put TV shows in a
different league than downloading a movie for which I would normally
have to buy a ticket, or music for which I'd have to buy a CD. I pay
for cable, so in my mind, I'm entitled to watch the show whenever I
want.
I also draw a distinction between distributing a show and receiving
a distribution. I'm perfectly entitled to receive a distribution
— that's what I do whenever I watch TV. However, you have to be
careful with your P2P client because there's a good chance you could
be distributing it as well, especially if you use a BitTorrent client or
have it in a shared folder for something like Kazaa.
If you proactively distribute the show — make it available to
others who may not be cable TV subscribers in a position to watch it
for free on TV — then you may be guilty of something.
At the risk of sounding combative, who are the TV stations to
decide when I have to physically plant myself in front of the TV? I
put up with cable rate increases every year, so I'll watch the show
whenever I please, thank you very much.
The bottom line, in my mind, is that I pay for cable TV. I'm just
not home when the show I want to watch is aired. Am I
over-simplifying this? Am I just trying to rationalize something?
I'm torn.
