Sam's gotta get his cut, too:
"The big issue is whether you're doing it as a business or
not."
[...] If someone is selling the junk that is collecting dust in a
garage or basement, then that person probably is getting less than he
paid for it — no profit here. But if someone is buying goods in
bulk from a wholesaler and hoping to make a couple extra bucks
reselling each one, then that person could have just started a
profitable business, Fooden said.

bring in some extra money so she can afford to stay home with her two
young boys. The additional dollars are great, but does she really need
to hassle with the paperwork and report her small profit to the
Internal Revenue Service? Her question, posed to the online auction
site's discussion board for sellers, generated much advice and
more confusion.

BBC Begins Experiments With Downloadable
TV
05/03/2004 03:50 AMLast year, the BBC generated a lot of excitement by announcing that
they were looking into ways to
offer
their entire archives online for free download. They even
admitted they were
looking
into file sharing as a distribution method, to avoid killing their
own bandwidth. Now, comes news that they're about to start
a pilot
program to offer downloadable shows from the past week. It's
unclear if this is an entirely different program than what was talked
about earlier. The focus is much more on programs that just went on
the air, which will then immediately be available for download - and
can be transferred to handheld PDAs. They see it as an alternative to
using a PVR device to record shows, and compare it to the way that BBC
Radio lets people download shows after they air. It's still stunning
that no one else does this with TV shows. It's easy enough to include
the advertising, and you pretty much guarantee that the show will be
seen by more people than otherwise. The article, though, doesn't
mention whether or not it will use any P2P method for distribution.
If there ever were a solution that screamed out for
broadcat
ching, this seems like a perfect one.

The Downloadable Music Business Shuffle
The Downloadable Music Business Shuffle
09/01/2004 01:26 PMAs Microsoft gets ready to
lau
nch their own music download store, Apple has a carefully timed
announcement
adding an affiliate program to
iTunes, so that individuals and organizations can get a tiny piece
of the pie for every paid download they push on people. The end
result, of course, will be to make iTunes' already miniscule margins
even smaller. This, obviously, is
of
little concern to Apple, since they still view the iTunes store
(properly) as a promotion for selling iPods. Meanwhile, Napster,
fresh from
sheddin
g their core Roxio software business appears to be in complete
denial about the marketplace. In an interview, Napster's CEO
brushes off all of the competitive questions
by pretending the real competition isn't competition, and then
pointing out how badly they trash the non-competition. Obviously,
Apple's iTunes is their main competition. However, he brushes this
aside, pointing out that Apple only does pay-per-download, whereas
Napster does pay-per-download
and subscriptions. Since iTunes
has no subscription offer, apparently, they're nothing. No customer
anywhere would
ever think of replacing one with the other,
apparently. Of course, he seems to be forgetting two things:
customers define what the competition is by deciding what products are
substitutes, and it's pretty clear they consider iTunes and Napster
substitutes. He also seems to completely ignore file sharing systems,
which while much of the sharing may be in violation of copyrights, is
still competition. So, with those in his blind spot, the competition
he does bring up is Wal-Mart and Sony, two companies who everyone knew
did a dreadful job creating music download stores. Any time you have
your CEO defining away your biggest competition on a technicality and
then bragging about how you beat the competition who had already beat
themselves, you should be worried.
Plenty Of Legal Downloadable Music Now
Plenty Of Legal Downloadable Music Now
05/27/2004 12:11 PMFor a totally arbitrary, but supposedly "symbolic" milestone, the
global music industry is celebrating that there are now
over 100
legal music services available. Don't ask what kind of sites make
it to the list, that's not the important part. The important part is
that now music lovers have more music formats to choose from than
ever. Woo hoo! So instead of making it easier for people to download
music in a simple, transferable format, we now have a bunch of
different formats that we have to track down from over 100 sources.
Sounds like progress to me.

Lessig's free book
still racking in the sales
Stanford Magazine carries a story this month about our chairman and
co-founder Lawrence Lessig's book
which has just entered its third printing. This is interesting because
the book is freely
available online for download (under a Creative Commons license),
and has been downloaded about 180,000 times. On the one hand an author
can give away free content for folks to remake into audio books,
translations, and other formats, and the author
still gets paid through traditional book sales. Amazing how that
works, and works so well sometimes. [via Copyfight]
It
will be very difficult to "prove" that the Creative Common license and
the freely downloadable aspect of
Free Culture improved
sales, but the book is selling and making it freely available has
clearly not STOPPED sales. I wonder if it is possible to show that
making books available for free electronically increases the sale of
real books? I wonder if there are particular genres where this holds
more true...

TiVo and Netflix to Partner for
Downloadable Content?
09/06/2004 04:33 PMHey, guys. I'm sort of taking the day off from news - finishing up
some freelance and doing a lot of behind-the-scenes catch up for
Gizmodo - but this was just too interesting not to talk about.
Newsweek is reporting that TiVo and NetFlix are planning on releasing
a system that would allow subscribers of both services to download
movies and television programs directly to their TiVos over broadband.
There's no confirmation from the companies yet, but this could be
huge. If they could figure out a way to let us take TiVoToGo
onto mobile media devices, we could finally have an all-you-can-eat,
legal video download option.

Netflix Moves One Step Closer To

09/22/2004 11:55 AMWhile Netflix and Tivo still haven't confirmed their
rumored
relationship, Netflix is still pushing forward with getting the
other pieces in place for any kind of downloadable video-on-demand
offering. They've now
signed a deal with Warner
Brothers to test movie downloads. Of course, this also
demonstrates some of the hassle Netflix has to go through to build
such a service. They need to go to each and every studio and convince
them that (no, really) if they let Netflix help them offer video on
demand it will let them rent more movies, and it won't mean the end of
the movie industry because some kid figures out how to break whatever
copy protection scheme they agree to use.
The Ongoing Fragmentation Of The
Downloadable Music Store World
The Ongoing Fragmentation Of The
Downloadable Music Store World
07/06/2004 05:28 AMWe've discussed many times the fact that there are simply
too
many downloadable music stores with too many formats out there.
It's not that we don't think competition is good, but all these
different formats, with all these different restrictions, and
different rules about which devices they can play on is making a huge
mess of the industry. It's leading to increasing
confu
sion and
resentment from
music fans who are pissed off that the music they can supposedly buy
from one store won't work on the music player they own, or can't be
mixed into a playlist they bought at another store. It's as if ever
retail music store in the world had their own format for selling
music. If you go into Tower Records they'll give you a CD which can
only play on a Tower Records CD player, while in Virgin they give you
a special cassette that will only play on special Virgin cassette
players. Any marketing person with half a brain would realize that
the market would be
much, much bigger if they settled on a
common format with fewer restrictions. First, the industry couldn't
figure out how to embrace file sharing, and now they're doing their
best to muck up download stores. It's amazing the recording industry
functions at all. It seems to function in spite of itself.
