Microsoft today received a Recommendation from the Japanese Fair Trade Commission (JFTC) finding that a single provision in Microsoft’s agreements with computer manufacturers, the non-assertion of patents -- or NAP - provision, is inconsistent with Japanese law. The JFTC has directed Microsoft to retroactively nullify such provisions and communicate to the relevant original equipment manufacturers that it will not enforce them.

Online journalists who published trade secrets about Apple back in December filed an appeal Tuesday arguing that the ruling violated the First Amendment and that Apple should first subpoena its employees or use computer forensics to determine the sources of the leak. Apple filed a civil complaint against unnamed individuals who allegedly stole trade secrets and posted detailed information about an unannounced Apple product last December, and on March 11, a California judge ruled that Apple has the right to subpoena the records of the three Macintosh sites that published details on an unreleased Apple product. "The California courts have a long history of supporting and protecting the freedom of the press," attorney Kurt Opsahl said representing the journalists. "The Court of Appeal will now get the opportunity to correct a ruling that endangers all journalists."

The Japan Fair Trade Commission (JFTC) said Tuesday that certain provisions in license agreements between Microsoft Corp. and Japanese PC vendors violate Japan's antimonopoly code. Should licensees believe Microsoft is infringing on their patents, Microsoft's current provisions restrict possible legal action, according to a statement issued by the JFTC. The JFTC decided such a provision unjustly restricts the business activities of the licensees and thus violates section 19 of the Antimonopoly Act, it said.
