While most US courts have determined that there's no trademark infringement in buying a search engine advertisement based on a trademarked keyword, there are still some cases going forward. So, it's a bit surprising (though, amusing) to find out that New York Attorney General Eliot Spitzer was caught buying trademarked keywords promoting his campaign for governor. The keywords in question were for AIG, the big insurance conglomerate that Spitzer has been investigating for fraud. From a publicity standpoint, perhaps it makes sense. People searching on AIG may associate Spitzer's name with the company, but this is a bit trickier than someone just trying to get some publicity off of a popular keyword. Spitzer now claims it was a mistake, and the ads have been removed. Of course, what's to stop someone else from buying the same ads, and linking them to Spitzer's campaign site? In fact, at the time of this posting, it looks like some random advertiser has picked up on this story and is advertising some random anti-Google site, claiming that Eliot Spitzer and Google "overstep their boundaries." Once again, people seem to be trying to make a point through popular keywords.

Craig McCaw has reportedly bought a Texas company, Clearwire, that has ITFS spectrum assets: The ITFS band is near the MMDS spectrum but was set aside primarily for educational institutions. During the last period of interest in MMDS, during the mid-1990s, some companies, including Clearwire apparently, negotiated with the educational institutions to use or buy the spectrum. The spectrum wasn't widely used by the educational organizations that controlled the spectrum. McCaw has long been interested in fixed wireless broadband. He founded XO Communications, which owns LMDS frequencies, in the mid-1990s. XO recently joined the WiMax Forum. ALso, Nextel owns a bunch of MMDS spectrum that it bought from Worldcom. McCaw has assembled a who's who list of execs to run the new company, being called Flux. Many of them are McCaw Cellular veterans and have held posts in other McCaw companies. Notable are Nicholas Kauser who was the CTO for AT&T Wireless and currently sits on the board of numerous Seattle companies; Rob Mechaley, who was one of the founders of RadioFrame and before that Wildfire; and Gerard Salemme, who has been involved with several McCaw companies including satellite company ICO. McCaw is notoriously mum about new ventures so it wouldn't be surprising if we don't learn details about this one for a while. But with real WiMax products becoming available in the near future, it would certainly be fair to suppose that the company may have ambitions of rolling out a fixed broadband offering using WiMax....

Many of the various adware companies that use sneaky install methods often hide behind the cover of their "affiliates." They say that it's really their affiliates who use a sneaky install process, and therefore, it's not their fault at all -- even though the adware companies often turn a blind eye on abuses. In the past few months, the various adware companies have all been claiming that they're reforming their ways and are trying to stop dealing with these types of affiliates -- which is the party line well known adware provider 180Solutions is using to explain their decision to buy up their largest distributor, whose reputation isn't squeaky clean when it comes to sneaky installs. Of course, this doesn't seem to make much sense. If 180Solutions is upset about CDT, why not just kick them out of the affiliate program? Why buy out the company and reward its owners for being sneaky and (supposedly) getting 180Solutions into all this trouble they don't think they deserve?

My cow-orker Annalee Newitz has posted a great editorial on the latest court battles over spam, pointing out the weird, anticompetitive and anti-speech aspects of the spam fight.
Microsoft is developing what it calls Bonded Sender, a program that would supposedly separate "legitimate" Internet marketers and bulk mailers from spammers. Working with a California company called IronPort, Microsoft will create a white list of Internet marketers who have paid a fee and demonstrated that they have no record of spamming. Companies participating in the Bonded Sender program will be allowed to send their email ads to HotMail and MSN users.

Given Microsoft's investment in the Bonded Sender program, it seems they may soon be in the business of serving as middlemen between emailer marketers and their webmail users. In other words, it sounds like the software megacorp is about to start competing with Richter. Of course, Microsoft could always call off its suit if Richter claims to have been rehabilitated -- and he pays his Bonded Sender fees!

In the spam wars, sometimes it's hard to tell the spammers from the antispammers.

The situation gets even more complicated when you consider the fact that Microsoft will do more than pick and choose winners in the junk email business. Bonded Sender will punish most the people who aren't even sending advertisements -- groups like Internet activists MoveOn.org, who send out millions of emails to alert their members to upcoming political events and issues. If these groups don't pay their Bonded Sender fees, HotMail simply won't deliver their email -- regardless of whether users have specifically opted in to receive it.
