Copyright Police
08/23/2004 02:46 PM
Fascinating statement in an otherwise news-free talk this morning at the PFF Aspen meeting by R. Hewitt Pate, head of the U.S. Justice Department's Antitrust Division. He seemed to indicate that the department has more than enough on its plate already without also taking on the role the entertainment cartel and its friends in Congress have been urging: copyright cops when it comes to ordinary infringement. Pate urged more self-enforcement -- not a totally happy thought if this means the industry gets the power to sue anyone who merely advocates the use of technology, including file-sharing, that might be used for purposes of infringement, as some are pushing today. But he threw some welcome cold water on the industry's wish for a government-led crackdown. "The idea that copyright shold be shifted wholesale to be a Justice Department activity is something people should take with a grain of salt," he said. Good.

Public's Right to Know video censored by
Justice Dept
08/28/2004 03:27 PM
Cory Doctorow: Michael filed a Freedom of Information Act request the the Justice Department to get it to release a movie called "The Public's Right to Know." The Department released part of the video, but redacted sections of it, claiming that since the video had been produced by a private contractor who hadn't assigned copyright to the feds, they didn't have the right to release it to him. How convenient. There's a reason that the feds aren't allowed to copyright the stuff they make with our tax dollars: it's stupid and dirty and irresponsible as hell to circumvent that duty to make the public's bought-and-paid material available to the public by failing to negotiate the rights when contracting out to the private sector. 08/29/2004 10:41 AM
Cory Doctorow: Becky sez, "The Justice Dept. blacked out (censored) the part of a Supreme Court decision that calls into question the willy-nilly use of the vague notion of 'domestic security' to suppress dissent. Oy."
Ostensibly, they would use their powers of censorship only to remove material that truly could jeopardize US operations. But in reality, what did they do? They blacked out a quotation from a Supreme Court decision:
"The danger to political dissent is acute where the Government attempts to act under so vague a concept as the power to protect 'domestic security.' Given the difficulty of defining the domestic security interest, the danger of abuse in acting to protect that interest becomes apparent."
The mind reels at such a blatant abuse of power (and at the sheer chutzpah of using national security as an excuse to censor a quotation about using national security as an excuse to stifle dissent).
